Hello,

I am really confused and would appreciate any help. I just received a 797-C rejection notice for form i-131 ONLY, stating that I have 2 things wrong/missing:

1. wrong check amount/no check present/check issues....they did not specify...just gave a vague general sentence about check amount being wrong OR check not provided OR....etc

2. outdated version of the form (i checked this, and indeed they did have a newer one so i ll redo that part)

They sent me back my form, and the photo i sent, and the letter i sent along with it explaining why i wanted AP (even tho i later realized this wasnt necessary when filling together with AOS).

I filed the entire AOS packaged i-485/EAD/AP Jan 2nd...got the email confirmation Jan 9th that they received it....and today this REJECTION notice for AP(i-131) ONLY....no word on 485 or EAD yet.

The check that i sent originally along with the entire package was for 1070 $ and i thought that was meant to cover everything.

WHat am I doing wrong?? please help.

PS. also when i go to check my case status online with the case number i received in the email confirmation it does say that

"On January 9, 2014, your fingerprint fee was accepted and we have mailed you a notice describing how we will process your case."

So does this mean my check was correct and my AOS is being processed?

what do i do with this AP i131 now, besides refilling a newer version of the form and sending that in?

When did you file the I-130 (which comes with a fee of $420)? Previously or concurrently with the I-485 petition?

1. If you filed it all concurrently then you had to pay a separate $420 for the I-130 and $1070 for the I-485 and BECAUSE you filed concurrently, there would be no fees for the I-131 (Advance Parole) and I-765 (EAD) applications.

2. If you previously sent in the I-130 and got the petition approved before sending in the I-485 with forms I-131 and I-485, I would think there would be waivers in fees for the AP and EAD also since you sent it in together with the I-485 so in which case, you would only pay $1070.

Did you do any of the above?

I m confused about i-130..I dont think that applies to my case. I had applied for a K1 fiance visa, received it, entered the US, got married to my US citizen husband and after receiving the marriage certificate we filed for an adjustment of status and we filed forms i-485, EAD form and this i-131 Advanced parole so that i could travel in case AOS takes longer than 3 months.

We filed all those 3 at the same time, in the same envelope and sent one single check for 1070$.

What is the i-130 form in this case for?

You shouldn't need the I-130 if you got married on a K1 visa, you just need to file the I-485, I765 & I-131 plus the I-864 and G-325a as per the guide:

I think you just got a boilerplate letter that covers both points as there should be no fee for an I-131 if it is filed with an I-485, the only time you ned to potentially pay a fee is for other circumstances where there isn't an I-485, for example you could have done that before getting married when you entered on your K1.

You should get the I797 for receipt of the I-485 shortly so I would resubmit the correct I-131 with a copy of that and the notice they sent you about it being wrong so you don't lose your place in line.

I think you simply used an outdated version of the I-131. Some folks are complaining that they can't open the I-131 on the uscis site because of an Adobe Reader error message. They search for a 131 via google and fill out an expired version of the form. Your check amount was correct, but you need to download a current version of I-131 and resend it.

K1 -- 129F: 3/15/13 + NOA1: 3/22/13 + NOA2: 7/1/13 + NVC: 7/20/13 + MED: 8/4/13 + USEM: 8/23/13 + K1: 8/31/13 + CFO: 9/4/13 + POE: 9/7/13

ROC -- NOA1: ? + BIO: ? + INT: + 751: ?

Agree with Pete - I wrote the wrong amount on my check, it was $5 over (in my defence it was for me and my two kids and I obviously added it up wrong) and I had to resubmit the whole lot again. But this was a blessing in disguise as the day after i sent it i realised I'd forgotten to include the required evidence and photos for the EAD and AP applications, so I got the chance to fix and resend along with a correct amount on the check.

$1070 is the right amount, so you have must have used an outdated i-131 form.

Sounds like it was for an outdated form. You sent the correct fee of $1070. Just redo it on the current form edition and wait to include a copy of the receipt notice for your I-485. The fee will still be waived.

Someone adjusting from a K-1 does not file an I-130.

Hi guys thanks for all the help.

sooo about that...

i just couldnt wait and decided to mail it earlier today...the new form, photos, copies of passport and visa etc. i wrote like a little note saying that the fee is included in my AOS i-485 filing fee and that they cashed the check...

the ONLY thing that i didnt mail was the NOA for the i-485 because i still DONT have it..and i didnt want to wait longer. so im just gonna pray it goes through and that maybe they can just check it in their system somehow (i wrote that in my note).

so that's that for now.

still no notifications in the mail about i-485 or EAD...but i got the email notifications and it says it has been mailed to me.
