hi everyone,

This is my story, I was a K2 (Dep. of K1). my mom married a guy but when we came to untied state he didnt want to file any of the forms for my mom. So we got stuck here for pretty long and nothing got done. my mom hired many lawyers and nothing come through, also recently the uscis denied my mom's application and ask for a removal (and the lawyer applied for something again for us so that we won't get deported). now I'm 21 and I got married to my husband (who is a us citizen), we want to apply for green card on our own. will the removal status affect my application? should i get a lawyer? what am i classified as (still a k2 or not or something else)? all i have is I-94 and passport. what should i put for immigration proceeding? when and where? it wasn't under my name everything is under my mom's name. What would be the best course of action in our part so that I could get approved?

As stated, you cannot adjust status since your mother did not fulfill the terms of her K-1, which directly affects you as the dependent K-2.

Have your husband file an I-130, wait for it to be approved, file an I-601A provisional waiver and then (hopefully) if that's approved you will need to interview overseas for an immigrant visa.

It's also sterling advice to have at least a consultation with an experienced immigration attorney familiar with waivers.
