Maybe someone who has some knowledge could answer this because I have been wondering the same myself. Aslo doing 1 I30 for my mom and want to know whether that would be the case if we would have to get her through the gov or from private as I won't be able to sponsor her through my job as it is not allowed.

The petitioner is sponsoring the parents. That means the petitioner (or joint sponsor) pays for everything. The purpose of the AoS is exactly that, to make sure the new immigrant will not become a charge of state. So no, the parents can get nothing from the government. Even if they somehow do, the sponsor (petitioner or joint) will have to pay the government back. And if the immigrant decides to apply for citizenship in the future, there may be unpleasant questions.

Ok so with the new law that states that every one has to get insurance and it is being under the Obamacare act how does that work that is actually my question. But I will do some more research online to see what I can come up with. Thank you

Affidavit of Support

Obamacare requires you to have insurance, it doesn't provide it. If you can't purchase it, you pay fines to the government.

Obama care is not a government insurance plan like Medicare or a state insurance like Medicaid. It is a subsidy to help pay for your insurance based upon your income. Your parents will not be eligible for Medicare unless they work 40 qualifying quarters in the US (10 years). They will not qualify for Medicaid for at least five years. If they obtain Medicaid or any means-tested benefit the government could sue the sponsor to pay the money back.

With Obama care aka Affordable Healthcare Act you purchase insurance through an exchange and receive a reduced payment. You are still buying the insurance from a private insurance company.

Thanks for all inputs. So he has to buy for his parents from his pocket. Problem is that his job doesn't allow him to buy for them. If there is no solution for the insurance, he can't sponsor them. Very few person affords to buy his own.

I hope someone can guide me thorugh this question. Now that my parents have received their visa and will be coming to US in October this year, I have started looking into options for their health care. They are both abive 65 and even though they fall under seniors residents (and not citizens), I am cusrious to know the following:

I know for a fact that they dont qualify for Medicare. They dont qualify for Medicaid oratleast the first five years.

From tax point of view I am just in a limbo what to dof or next year. I would love to claim them as dependents on my returns but then if I do claim them then my income (or the household income) will be used to determine their income for any benefits. Not even that but lets say God forbid there is some emergency then the hospital would use the total household incoem to see their eligibility for any forgiveness.

Now if I do file their returns separate and show zero income, would it really help i terms of them getting a lower rate or benefits or would my incoem still play into effect even though for tax purposes they are not part of my household. Should I just file them as depedents for next year?

I tried calling healthcare and they told me that it depends. They cant give me exact figures but they told me this that they dont qualify for Medicaid or Medicare but they maybe able to qualiy for something else. And the premium would depend on whether I am claim them as dependents or they file their own return. I giess there is upsight to both. Claiming them on my return would be great as I can take advantage of tax credits or have them file and show zero income and then see what to do from there.

USCIS Step:

01/28/2014: Email Update/Txt Received for Approval

02/01/2014: Approval Notice received in Mail

****** Both I-130s approved in about 9.5 months ******

NVC Step:

03/19/2014: Paid AOS online (one payment for both cases)
