Royo, I will give you a link to a USCIS manual and even though it might be a little long, it is very good you read it all since it is very intuitive, more detailed and answers a lot of the questions we usually wonder about. It includes RFEs and how they adjudicate them. It is a manual to be used by USCIS staff.

However from what I have read in threads here and in the manual, when you get an RFE, it is best to resend everything regarding the particular RFE or form because the adjudication is now done based on the new evidence not on the old evidence. So for example, if I forgot to include proof of my total current income and I get an RFE for it and I send in only a pay stub showing the current individual annual income, that would most likely result in a denial because the adjudication will be done on the new evidence which will be ONLY the pay stub. So in responding to the RFE, they recommend sending in - the form I-864, tax transcripts, pay stub and/or employment letter and proof of citizenship of the sponsor.

That is why the letter tends to sometimes ask for things you've already submitted. But remember when it comes to the government, it is better to send more than less. They are paid to do that so let us give them some work to do lol.

Regarding your case, I believe you should include everything regarding the form I-864 and the new evidence they are requesting. So perhaps the RFE was for the missing proof of citizenship, but please send in - the I-864 form, tax transcripts, employment letter and/or pays tubs showing current individual annual income and proof of citizenship

does anyone know if i could still receive a biometrics appointment in the mail while my RFE is pending? I am here wondering the same thing!!

It says online that on jan 24th they mailed me an RFE letter for AOS..still nothing in the mail...

they initally received my AOS application on Jan 10th i believe. How long after they receive it do they send the biometrics appt letter?

also, from people's experience and research, how long do you think it takes after biometrics to actually have the green card interview or EAD card mailed?

Hi CJC. That's nice that at least there's been some progress. I filed mine on 01/14/2014 and they received it on 01/16/2014 so looking at your timelines, I believe they might have already sent my biometrics letter too lol. Good luck!

CJC. That provides some relief. My case status also shows I-130 and I-765 both at initial review whilst I-485 is at the Acceptance stage. I guess it doesn't imply they aren't working on it..since you got your biometrics and we have the same timelines. I heard after the biometrics, everything begins to move a little faster. Are you planning on doing an early walk-in? And filing for an expedited EAD? Looks like it comes in handy when you do. There are folks who did it and got their EADs around 40 days of filing instead of the usual 60+ days.

Hey AlphaMale...I was thinking about doing the early walk in but I have decided to wait, mostly due to logistics of getting there. As for the expedited EAD, I didn't think that I had grounds? I might have to check that one out as having the wait reduced would be fabulous. What about you? What are you planning on doing?

I am hearing you there. Two incomes = awesomeness...kicking.gif (and more shoes..ha ha)

I also looking forward to meeting new people. My hubby gets ear blasted when he comes home everyday because I haven't spoken to a soul all day long. Once this son-of-a-polar vortex eases off I will be able to walk out and about and stalk the local folks at the library to give him a break....

Hi kiki2013. Sorry to hear about the RFE. Hope it is something easy to remedy. As for the biometrics, I received mine 2 weeks after acceptance of my AOS. I am guessing that the biometrics might be held up due to the RFE but I don't know for sure. The bottom of my biometrics appt states it is for both the AOS and the EAD, so maybe it will come for the EAD on its own, which might take a bit longer.

EAD's take around 2-3 months to be issued and GC's a bit longer. Checking your local office processing times might give you a good indication of wait times. My local office (Milwaukee) currently has a minimum of 7 months wait. I am optimistic that it will go like Elvis and 'go man go'...ha ha...but the main thing is to have the EAD. AlphaMale mentioned expediting the EAD, that might be worth looking into also.

So happy to hear that Nurseling.....fantastic news.

I sent my stuff in on the 15th, they received it on the 16th but I didn't get the email/text notice until around 10.15pm January 20th. The hard copy notices arrived on the 25th and today I received my biometrics appt, This part moves really quick, which is a relief. On USCIS status thing, my EAD/AP cases are at the 'Initial Review' stage, however my AOS is still on 'Acceptance' stage and all cases were last touched on 01/22. Hopefully that helps with timing for you.

So far just finger and toe counting as far as days go and it seems to be the norm, which is great. Hope you hear really soon...fingers crossed smile.png

4/10/2014 ( 75 days) status changed after calling uscis regarding urgency of EAD. Also usps tracking number at 20.580pm

It wont help if they have 2 applications on their desk, and if you did put USCIS and Chicago on the envelepoe, then it should really make it!

Maybe there was a little typo on the address and they just corrected it.

Yey, finally got a usps update at 6pm tonight..they rerouted it to the sorting facility, at 8pm it was out for delivery to address already..its weird though (delivery at night?) I thought government works 8-5 only. Thanks for the support guys. We hope it will be to final destination this time.

The USPS website says delivered just now. Actually was delivered on the 27th it was the usps that didn't update their system. So thank god.

So yours took two days before a text was sent from uscis? Was that just them accepting the application?

Online still says 'acceptance' for AOS and 'initial review' for EAD and AP.

P.S I sent a copy of my marriage cert...not an original.. woops :(

It really is my hope it goes quickly for you - Friday night would be grand yes.gif What a nice segue into the next leg of this journey.

I am planning on doing some tax prep work and investigation on how to get rid of cable - thank goodness for my to-do list!
