Does your contract stipulate a bond (certain amount to pay if you left the company earlier than the contract's expiry)? I say just pay that and go on with your plans. If the amount is ridiculous, just leave and ask a friend to hand your resignation letter to your supervisor the moment you are in US soil. They can't put you in jail for that reason. Don't even consider re-filing, honey!

so i got my k1 visa and it expires on may2014. i already booked my flight and then my current employer wont allow me to resign and threatens me for a breech of contract. my employment will expire on september 2014. what should i do?

questions,

1. if i allow my visa to expire will it automatically be cancelled?

2 follow up question: can we refile for another k1 or is there any extension for such visa?

3. what could possibly be our options?

A consular officer can revalidate a K visa petition any number of times for additional periods of 4 months provided the officer concludes that the petitioner and beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary’s admission into the United States.
To have the petition revalidated send a written request to the Embassy that includes a statement of your intention to go forward with the marriage.

Lots of companies use scare tactics too. We had a young woman in an IT position who wanted 1-2 weeks off for a SG trip. They made her sign something saying she wouldn't search for work while there. She did, got a job as a software tester and lives there to this day.

These policies don't get you loyal workers, they just make people even more likely to jump ship.

When I left my old job mid-contract, my contract stated I had to pay a bond of $3000. And...I paid it. Yeah, I was stupid.

But, some months after, I found out that many of my colleagues left and returned to their home countries without giving more than a day's notice and definitely without paying the bond.

Company didn't bother to go after them because it would have cost them more to pursue legal action than reclaim the bond.

Flying to Seattle on 6 May 2014!

To have the petition revalidated send a written request to the Embassy that includes a statement of your intention to go forward with the marriage.

They can revalidate an I-129F petition past the expiry date written on the NOA2...I don't think the same applies to the K1 visa, once issued.

I agree on the petition bit, but if you were trying to say this about the VISA, I disagree.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
