Hey guys I need your help

I came to USA as an Au Pair a year ago and my j1 expires sep /2014, the problem is I met someone 4 months ago and I really like him, I have told him my situation about my status and All and he thinks we should get married when my contract ends with the family.

The problem is that... As a girl I would love to plan my wedding and all, and just signing the papers is like not what I pictured it to be lol

2nd thing is that... I know about the k1... Do I need to travel outside USA to file for K1? I'm here and my year with the family ends sep 2014... So is filling for K1 a good idea? Or should I just get married?

I have also tried F1 but OMW it's sooo stressful, financially and mentally

Please help guys

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If you're getting married, he must start the process by filling out the I-129F petition, pay the fee, provide proof of relationship. After 4 months, I would think they would not view it as a bonafide relationship. And, if you think F1 is stressful, financially, and mentally....K1 is no cake walk. It is just as stressful, financially draining, and very mentally draining. Our process took 8 months from start to finish, and we are getting married on January 7th and then start the naturalization process. I believe you have to go home to your country in order to complete the K1 process from what I gather.

I'd re-check what you think you're doing - you're a long way from filing for naturalization.

You first have to do adjustment of status so you can get a green card after your marriage.

Then, 90 days prior to the second anniversary of your green card (NOT marriage), you will file I-751 to remove conditions on your residence and hopefully get your 10-yr green card.

After that you can consider filing for naturalization if you're still married to the same USC - 3-yr marriage based naturalization filing. Or, regular 5 year residence filing.

I'd re-check what you think you're doing - you're a long way from filing for naturalization.

You first have to do adjustment of status so you can get a green card after your marriage.

Then, 90 days prior to the second anniversary of your green card (NOT marriage), you will file I-751 to remove conditions on your residence and hopefully get your 10-yr green card.

After that you can consider filing for naturalization if you're still married to the same USC - 3-yr marriage based naturalization filing. Or, regular 5 year residence filing.

You could have your cake and eat it to, so to speak. If you want to have a small legal marriage ceremony now, inside the US, you can. Then you could start the AOS process and plan for a larger wedding ceremony with family and friends at a future date. You could renew your vows at this ceremony and it will be just like the real deal. This way you will not have to be separated from your boyfriend while waiting for a fiance or marriage visa to be approved.

This is what many people do when they just don't want to leave the love of their life. Really, no one but immigration and you as a couple need to know you're already married. Keep it on the down low and spend the year planning a big wedding for friends and family. WEEEEE
