Hi there,

Found out good news today. Got a letter saying the removal of conditions for my wife has been approved. We are very happy. Only thing though, we want to take a trip back to see her family and it says the card will take up to 60 days to come. We were hoping to take the trip next month for the Asian New Year observed in many countries. Is it possible to go with the passport (of the origin country), expired green card, and letter that states that her green card is approved? Will this be okay or will we need to wait for the card to come? Her family was hoping to see her for the new year.

Thanks!

Hi,

I don't think you need to worry. The Green Card usually arrives about 1 week after approval - if you look on the Removing Conditions Forum, you will see the approval and card arrival dates for filers of each month. In the very unusual situation that the card doesn't make it - I think you would be fine with the expired card and letter. At the US end, they will be able to see the approval in their system.

Happy New Year!

all this stuff will get her on the plane in the Asia Country, and through a POE in the USA.

provided, of course, the issue date on the letter isn't 1 year + 1 day before the POE date.

You could also make an Infopass appointment at your local office, take your wife's passport and I-751 approval notice, and they would be able to give her an I-551 stamp in her passport. That stamp would serve as temporary proof of a green card until the unrestricted card arrived in the mail.

You should be getting a notice that the card has been mailed out in about a week or so. Then you should be getting the card within a week of the card being mailed. So you should be able to get the card long before you need to leave for your holiday. Now this is assuming that USCIS is processing everything the same way they had with me and the people before me - so I can't guarantee that this will be exactly what's going to happen to you. I would wait out a couple more weeks and if you still don't get anything then consider the Infopass method or use the 1-yr extension letter.

ROC Journey:

4/24/13 - Submitted I-751 application

4/26/13 - I-751 officially filed

6/11/13 - Biometrics done

8/14/13 - Rec'd RFE

9/21/13 - Submitted RFE response

9/23/13 - RFE response rec'd at VSC

(about 2 months later)

11/21/13 - Service request via Tier 1 submitted

12/11/13 - Response to service request rec'd - vague info about processing times

12/12/13 - Service request via Tier 2 submitted

12/10/13 - APPROVED!!! (letter rec'd 12/14/13)

12/16/13 - 2nd Service request response rec'd

12/17/13 - Card production email/text rec'd (online case updated)!

12/24/13 - Notification rec'd via email regarding card mailed on 12/23/13 (online case updated as well)

12/26/13 - 10-yr card rec'd!

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.
