So I figured I'd start getting documents ready for the next stage now that I have my NOA2 hardcopy.

I decided that it would be best to add a co-sponsor to the I-134. But I’m having a dilemma. I’m planning on using parent(s) info. The thing is that they file their taxes jointly but my dad, who is a LPR, doesn’t have employment due disability from a stroke. Yet, my mom only has TPS but is employed.

Either way the info is the same because of them filing jointly, but who do name as the co-sponsor? Or should I just use both? And if I do use both do they each need to complete an I-134?

you mom cannot be a joint sponsor because she only has tps. to finacially sponsor someone they have to be a USC or LPR

your dad can but his income would have to be 125% over to poverty guidelines to cover himself, his family and your fiance.

he would put his individual income, and a letter from SS stating what his monthly income is from disability. if it's not enough then you'll have to find someone else to be your joint sponsor. your mom's income doesn't count.

I looked at the i-184 poverty guidelines and it states that 125% for a family of 2 ( I'm assuming myself and my fiance) should be over 19K.

After looking at my 2013 final paystubs, I see that my income is roughly 22K. I'm worried that, even though I'm over the 19K, it still won't be enough.

Hence why I decided it probably be best to have the co-sponsor. My dad gets about 8 or 9K yearly from SS. I understand that my mom's income won't count but since they file jointly does this mean that I'll have to count her as apart of his household?

Which wouldn't look good... and would look even worse if my fiance is included (according to quote)

I was under the impression that the co-sponsor's income would be combined with the petitioner/ orginal sponsor's income. So I find it interesting that my dad's income would have to cover my fiance (and my mom if she is to be counted as apart of my dad's household) since technically my fiance would be counted as apart of my household.

To me it seems that my fiance is counted twice in two different households. A household of 2 for me (again I'm assuming myself and my fiance) and 3 for my dad (him, my mom, and my fiance). blink.png

If I don't have to included my mom as apart of my dad's household, then our combined income is about 31K for me, him and my fiance. good.gif

First of all, if you are above the 125% guidelines, even by $1, you are perfectly fine and no need for a co-sponsor. For purposes of household size, a spouse and the person being sponsored are ALWAYS going to be included. This means if your dad is a co-sponsor, your mom is included in the household size. Your fiance is also included because your fiance is the one being sponsored.

your fiance will appear on both of them

as you are the main sponsor since you are the petitioner he will appear on your i134 since you're filing the fiance visa, but if you made enough this year, then you won't need a joint sponsor

your dad has to have enough to cover his own household plus the beneficiary which would be your fiance spouses and dependent children are counted as part of the household

the petitioner and co-sponsor can only combine income if they live in the same household. that's the difference between a co sponsor and a joint sponsor. I know that's possible for the adjustment of status when petitioner files the i864 and the household member files the i864A, but now we are talking about filing two i134

the same will happen after you marry and have to file adjustment of status. but it looks like you make over the poverty guidelines
