1- first get all the proofs , sending any email without the proof attached to it is useless.

2- get in touch with your congressman and ask him/her to send a compain to the state deprtment about FPU error and an email to the IV section in the embassy

i am going to do it tomorrow but it will take 3 days to get this 2 papers and notarize them and then 3 days more if i translated them and i dont know if i need to translate them or no

Try your best to expedite it. I don't think notarization is necessary. stamping from the issuing authority is enough. for now, send them in arabic just to make them stop and look at your case. make sure when you send them an email, that you would like these documents to be sent to the FPU for re-investigation, and inform them that there is a name similtry and the decision was not right. if you can make your congressman to send them another email, they will take it more serious

When the embassy returns K1's they go through NVC first and then back to USCIS, so maybe you can send NVC copies of the same things just in case the embassy has already returned them via NVC. Petitioner needs to call DOS also and inform them. If there is anyway to speak to someone

from the fraud investigation unit I would inquire through the congressman.

No one suggested that the congressman can order the CO, DOS or USCIC to do anything. It is not about ordering anyone to do anything,

it is about inquiring and receiving information through the representative's liason. It is about focusing their attention on a mistake that

has been made, a mix up.

With that a congressman definitely can help if the CO chooses to listen, which is at his/her discretion.

A good liason and a CO or fraud unit willing to correct their own mistake and you got yourself a winner.

Did you attach proof when you emailed the embassy ?

Was the congressman's liason utilized ?

Has your fiance been involved with contacting the embassy ?

A petitioner pulls more weight than a beneficiary with the embassy when there are problems such as this. Understand that a beneficiary often gets ignored when trying to maneuver through the appropriate channels.

Again, get the petitioner involved.

If not then it sounds like they are done with your case and you now have to focus on getting the attention of NVC while it is there

and before it goes back to USCIS, do it through the congressman.

Usually once it has been out of the embassy's hand they will not recall it and it will run its course and you have to

submit your evidence that the CO was mistaken when and if your petitioner will file for you again.

I still hold out hope that a congressman will point out the mistake to the FPU and CO and also NVC and due to the fact

that it was a mistake or mistaken identity that they would reconsider. Unfortunately the discretion of the CO is such that

if not willing to take another look they don't have to.

Therefore a skilled liason understanding your circumstances well (because you have provided detailed information on educating them on it)

and armed with proof and evidence can get you on the right course again. Proof of the right documents and acting quickly is the key.

I called USCIS and talk to an officer saygon, he will be putting in a service request to the USCIS California office, he said what will happen is they will pull the file and review at, then I should receive a reply from them by the 6th of January if I do not receive anything by the 6th I will call them back.

they will be able to relate any information,

that the USCIS has on the case.

I called dos 1st, they referred me to the uscis office and told me to call. I also have to use our USCIS receipt # WACXXXXXXXXXX not our # from the embassy receipt.

Congressmans office has nothing to do with it, thats y I called USCIS. They are pouting in a service request, what she can do more?
