I applied i130 for my brother about a year back and is still pending. My brother moved to the US in the beginning of the year on a student visa.

My question is,

Do i have to notify the USCIS about this? Will this make the processing any faster?

Cant wait till this is over!!

Your brother won't be eligible for a visa for 10 years. Until that time he must NOT overstay any other visa to the US as overstays are NOT forgiven for siblings. The petition will not move faster because he is here.

unless he can legally stay in the US for 9 or 10 years until his priority date becomes current, there is no need for change of address. he cannot overstay any type of visa he has, he must return before overstaying

there is no way of making the wait faster.

Thanks guys. I just wanted to be sure. One more thing,

The processsing time in the USCIS website for a US citizen applying for a brother/sister in california service center is shown as 44.2 months. This is as of sep 30, 2013.

Now how accurate is this? Should i trust it???

You guys just mentioned above that it takes about 10 years?? Where did you guys get that information?

Cant wait till this is over!!

You need to check the visa bulletin. Yhe USCiS processing is only step 1 to see if you have a proper petition. After that you have to wait for a visa number to be available. SIbling petitions are limited in number each year. Under sibling petition they are working from 2001 in most countries. ( F4 class ) Between 44 months and current your petition sits on a shelf in a warehouse

hi,

that's only the i130, after that the i130 will be sent to the National Visa Center, where it will sit until the priority date becomes current

he will have to check every month to see on what date immigration is working on
