Timeline

Hello everyone,

I just mailedmy I-129f packet today. In it I have the content page for the folder which states everything includes in the packet. I had included in the packet photographs of my fiancee and I, but when I got home I discovered the photos fell out and were in my backpack. Are there any suggestions as to what I should do? Would there be a problem. We added more proof of.having met in.person, but I'm a little nervous they might not suffice. Thanks.

Alright, this is just a guess, and keep in mind I really have no idea what I'm talking about on this! So I could be very wrong. But I think, they will send you an RFE and request more evidence - if they need it. That seems like the most logical thing. Because you can't unsend what you've already sent. And you can't just send in the photographs by themselves. I think you'll have to wait for them to ask for them. That's just my guess.

If the review officer is satisfied with your supporting documents even with or without the photos. Remember the USCIS has other means of checking your background. Just pray that things will goes well.

Actually, I had the I-129F Instructions opened on my computer and just as I was going to close everything I saw this. It probably best addresses your situation. It looks like they may either reject it outright or they will request the missing information. But if they reject it you should have a right to appeal it. Maybe you should call them next week and just ask.

Initial Processing

Once Form I-129F has been accepted, it will be checked for completeness, including submission of the required initial evidence. If you do not completely fill out the form, or file it without required initial evidence, you will not establish a basis for eligibility, and we may deny your Form I-129F.

Requests for More Information or Interview

We may request more information or evidence, or we may request that you appear at a USCIS office for an interview. We may also request that you submit the originals of any copy. We will return these originals when they are no longer required.

Decision

You will be notified as to whether you have established that your spouse is eligible for the requested classification. If your petition is denied, you will also be provided with information regarding appeal rights and procedures.

Hi,

This just an info and your right, they might and might not. Usually the rejection comes form not filling out the form correctly or misinformation about the two of you. Photos and picture are also considered as substantiation about your relationship. As I have mentioned the CO will determine if your relationship is valid or fraud. So don't worry too much. I haven't come across any VJ members here being denied by forgetting to submit photo's. I'm pretty sure they'll contact you once they require it, otherwise just bring it on your interview date. Ours didn't forget to submit the photos but on my interview, they did not even bother to look at any of our photos which I brought a bunch (lol)

Photos are just secondary evidence and are not "critical" for the I-129F to be approved. The I-129F instructions do not specifically list photos:

Such evidence may include a written statement from you and/or the beneficiary stating the exact date(s) on which you met in person, copy of airline tickets, pasport pages, or other evidence showing you and the beneficiary have met in person during the requisite time period.

If you included enough "primary evidence" such as boarding passes, passport entry/exit stamps, credit card receipts/hotel receipts, to show that you have met in person within the last two years, the adjudicator may have enough information on their end without needing the photos.

The only photos that are required are the passport sized photos to be attached to the G-325A - were those in the zip lock baggy as well? If so, you may receive an RFE for that.

it really depends on the officer... photos, as VJer mentioned, are secondary evidence... the officer might or might not require them.... however, be ready to have them handy for the interview day in case they ask for them... if anything you would get an RFE and you can send them... no worries.... you will be fine...

that should not be a problem... I have heard people getting RFEs requesting the passport pics even though they had originally included the photos,... others because the photos were not passport size.... it is recommended you place them in a zip log bag right with the G325 forms but if it should not be a big deal... good luck on your journey!

They don't have to be attached to the G-325A specifically (although it would make them easier to find). I was referring to the OP as he said the photographs of himself and his fiancee fell into his backpack - if the passport-sized photos also fell into his backpack then he would probably receive an RFE as they are required.
