Hey all,

the USCIS status on my case says they received my application on November 20th, today my husband said the cheque has cashed.

Does this even mean any sort of positive outcome (initial approval) or they just cash every cheque?

I just know the status on the USCIS reminds you it can be denied within 2 business days, does this mean I have moved past this?

If it is denied, do we have to spend another $1070 to send it out again?

Thanks guys!

It means your package was deemed complete enough to start processing it. To start the processing they take the money. It's not good really, but it does mean that you signed every form and sent the correct check amount.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

So would you say that the "2 day denial" possibility has been conquered? That I will not be denied and sent back my packet?

We hadn't sent in my vaccination or the i 129 approval copy (they never sent me one), and we only sent W 2 for tax returns not W 2 and 1099.

There is no such thing as 2 day denial. Your packet can be rejected for being so incomplete they can't even start to process it. Or it can be accepted for initial review. If you missed a bunch of evidence they will send you an RFE. Acceptance now just means you signed the forms and sent the right money.

I don't know what the "2 day denial" is. All the check being cashed means is the check was for the correct amount and all the forms were signed. It does not mean everything needed was included or that there will be an approval.

Taken directly from USCIS status check website...

On November 20, 2013, your fingerprint fee was accepted and we have mailed you a notice describing how we will process your case. Please follow any instructions on this notice. Your case is being processed at our NATIONAL BENEFITS CENTER location. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

During the acceptance step USCIS reviews newly received applications and petitions to ensure that they are properly filed (i.e. signed by the applicant, appropriate fees, etc.) USCIS issues a receipt number for the application or petition, and sends a receipt notice to the applicant or petitioner.

Applications and petitions that are not properly filed are rejected with an explanation of why the application is rejected and the corrective action needed. Rejected applications or petitions do not retain their filing date.

The acceptance step is typically completed within 2 business days of when the application is received. With mail time it may take several weeks for you to get the receipt or rejection notice in the mail. If you do not receive your notice within 30 days of mailing your application, please contact our national customer service center at 1-800-375-5283.

...Note the acceptance within 2 business days. So if cheque cashed, does this mean its not going to be rejected, denied, and move onto further processing?

I don't mean is my green card accepted, I mean is it moving further and we won't have to re apply again. I am sure there will RFE for the tax and vaccination, Im fine with that - just wanted to ensure I was not "rejected" as per what it says above.

"are properly filed (i.e. signed by the applicant, appropriate fees, etc.)" exactly what it says, you sent the right amount of money and signed all the forms. That is all the mailroom looks for and sometimes they miss a form that was not signed. It is no guarantee all the forms have been submitted, that they were filled out correctly, or that the application will not be denied later. It just means that some low-wage worker with little to no knowledge of immigration procedures saw a check for the correct amount and thumbed throught the forms to see if they were signed.

Okay, no need for attitude..This is a website to help people along their VISA journey. I am aware what was stated, was hoping someone with GC experience would offer a kind response. Which I have received prior to yours, thanks.
