It comes from the I-129F instructions. It is a requirement to have met in person within the 2 years prior to filing the I-129F petition.

Of course I know that! You didn't get my point. We, my fiance and I waited for 2 yrs before filing the petition. But SOME people got approved even when they online know each other for 1 year and only met ONCE, I don't understand why USCIS approved those petitions. That is so unfair.

You are the one not getting the point or understanding the requirement. You did not have to wait 2 years. You do not have to know each other and be in a relationship for 2 years before filing. You just have to have met face-to-face in person only once anytime during the 2 years prior to filing the I-129F petition. They got approved for their petitions because they met all the requirements of the I-129F. There is nothing unfair about it. I am confused by your misguided outrage.

that 2 year rule s*cks! I've been reading some timelines that they met online and know each other for just a year and visit just once! they filed for i129f and they got approved!! So whats with that 2 year period?!!

Its just depend on how you send that form. Just make sure you send them what they need.

1. form

2. letter of intent

3.proof of relationship

4.financial support (that helps alot)

5. copy of itinerary,tickets,hotels receipt

6. birth certificate (copy)

7. passport copy

8. payment

Also, financial information is not required with the I-129F petition. The financial documents and I-134 are needed for the actual K-1 visa interview. You state it helps a lot. It does not help at all to send financial documentation with the I-129F petition and you will just have to submit again at the K-1 interview anyway.

JAN 2012 (MET ONLINE)

DECEMBER 2012 (FIRST VISIT)

JAN 2013 (FILED FOR 1-29F)

APRIL 2013 (NOA1)

AUGUST (NOA2)

OCT (NVC RECEIVED)

And on my case, WE NEED TO WAIT FOR 2 YEARS BECAUSE WE JUST MET ONLINE. 2 YEAR RULE STARTED WHEN I WENT TO HIS COUNTRY AND SAW HIM PERSONALLY.

So...ends up we made the mistake of submitting evidence that was too recent. I was afraid of this, after having read comments by others. I wish they would be more clear and maybe like, underline or HIGHLIGHT importand things like that. As far as I remember, the RFE stated that we needed to send evidence of our most recent meeting...without stating the importance of it being BEFORE we filed. :(

So we just wasted three months and $340.

So now we refile. I understand that to appeal is useless because it will only change things if it was THEIR error, not ours.

what did you submitted when you got the rfe?

I also got rfe(proof of relationship & evidence)

I sent them a letter telling them how we met and how we love each other and some pictures too since i just came back from his country that time. and we got approved. There is nothing wrong with the timeline you posted. They met in person in Dec, 2012 and filed in Jan 2013. That absolutely meets the requirement to have met within the 2 years prior to filing.

You can use all the capslock text you like. You did not HAVE to wait for 2 years after meeting in person. You do not understand the requirement, even while I am trying to explain it to you.

I will try it with your sample timeline:

A couple met online in Jan 2012, then they met face-to-face in Dec. 2012. That means they were eligible to file the I-129F from between Dec. 2012 through Dec. 2014. They could file the I-129F petition at ANYTIME within those 2 years. They have NO REASON to wait 2 years until Dec. 2014 to file. That is not the requirement Please re-read the I-129F instructions I posted in this thread and re-read what I and others have told you. You only have to MEET in person sometime, anytime, just once during the 2 years directly before you file the I-129F. You do not have to KNOW each other for 2 years before filing, or wait 2 years after meeting in person to file.

If I am not understanding what you are trying to say, then it is because you are not explaining it well. Why would you HAVE to wait 2 years to file after meeting in person? Why is it unfair that others met in person after a year of knowing each other and filed their petitions and were approved?

So, you received an RFE about proof of meeting and sent evidence of a meeting that was not within the 2 years prior to filing your petition and then were denied? If I followed all that and got it right then yes, you need to just re-file. Sorry about your loss of the fee and extra wait time. Petitions seem to moving along fairly quickly right now, so hopefully you will not have to wait too long to get your approval after filing again. Just be sure to include all required documentation this time around The guide here on VJ lists everything you need.

How is that unfair? Are you saying people who only met once has a less legit relationship than yours? USCIS approved petitions like that because couples like us MET THE REQUIREMENTS. Nothing is unfair if we are all being asked the same thing. How many times we met nor how long our online relationships are have nothing to do with others approvals. We don't take away or lessen their chances just because we got approved. Its how well you prepare your petition.

Thats what i knew because we consult a attorney last year and thats what he said. He said that we need to be in a relationship in 2 yrs. but if we get a atty. they can do something about it.. I guess he only said that so that I can we get him to fix our petition. SMH !! If I only knew that thing maybe my fiance is with me right now!! :( :(

Yes, that was a lawyer that was saying anything to get you to hire them. No need to be in a relationship for 2 years. Actually, if you meet in person and then wait 2 years, it will be too late to file the I-129F based on that visit. And, sorry you waited when you did not need to, but at least you ended up with more evidence of relationship to present at the K-1 interview since you have been together for 2 years and perhaps had more than one visit in person.
