My husband is an American Citizen, and we applied for I-130 visa on March of this year (more than 8 months ago). In the USCIS timetables we have seen that on September 30th there where accepting cases from October 2012. As it might be a long time for getting my Green-card, I was interested if I can apply to another type of visa that could let me work in the meantime.

Thanks in advance.

This depends on whether you are in Spain or in the US right now.

If you are in Spain: No. You can visit him on the visa waiver program, but you cannot work in the US.

If you are in the US: Did you file an I-485 application for adjustment of status along with the I-130? If yes, you can submit an I-765 application for employment authorization which, when approved, allows you to work in the US while waiting out the I-130/I-485 approval.

You can get any work visa. You need to find a job, they need to agree to sponsor you for work, you have to fill out forms and wait for the visa, etc. The likelihood of that all happening in the next month or so is unlikely. Chances are before then you will have NOA2 and be ready for a consulate interview. Study up on the NVC shortcuts so you can go fast through that step.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

What visa did you have in mind?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

So you should send in an I-485 adjustment of status form, and a I-765 application for employment authorization.

If you are already married, you can stay legally, and you can work in 60 - 90 days after applying.

Read the adjustment of status guide on the top here.
