Hello VJ!


I'm writing again because today our lawyers sent us filled the affidavit of support.
I CAN'T BELIEVE HOW CAN THEY BE LAWYERS!ranting33va.gif


They put a bad amount of money, they didn't count my fiance's daughter AND .... they said "IF YOU HAVE MORE MONEY IN YOUR SAVINGS ACCOUNT OR IF YOU OWN A REAL STATE OR THAT DON'T PUT ANYTHING, YOU WILL CONFUSE THEM. IT IS ENOUGH WITH YOUR INCOME BECAUSE YOU PASS THE POVERTY GUIDELINES"

Don't judge because i have MORE THAN CLEAR that lawyers are the worst mistake on doing this paperwork but it was too late when i notice that. Anyway .... i need help of my VJ community.

I made this questions yesterday:

On question #8 - THE FOLLOWING PERSONS DEPENDANT UPON ME FOR SUPPORT (CHECK THE BOX IN THE APPROPIATE COLUMN TO INDICATE WETHER THE PERSON NAMED IS WHOLLY OR PATIALLY DEPENDENT UPON FOR YOUR SUPPORT)
Should he put a check on " partially dependant"?

On question #9 - I HAVE PREVIOUSLY SUBMITTED AFFIDAVIT(S) OF SUPORT FOR THE FOLLOWING PERSON(S)
A child support is like an affidavit?


To clarify, my fiance have a daughter of 7 years old. He shares half custody with his ex wife having their daughter in equal times. Besides that he pays child support so we are confused here. I had an answer about question #8 that said that no matter what box he cheks on, his daughter MUST be there. Ok i understand that BUT ... i know that he should check one of those 2 boxes, so ... which one is the correct to check due to his situation?

Also i want to clarify question #9 please!

And the last question, on the part that says: I DERIVE ANNUAL INCOME OF: ... Should he put his Total Gross Wages OR Net Pay?

I hope that new people that are having doubts on hiring a lawyer can read this and realize they are not only useless but a complete WASTE of money.

If he claims her on his taxes then he needs to count her as "wholly dependent" because he claimed her dependency for tax purpose and you cannot claim a benefit if you did not support the person more than 51%. Otherwise, if the mother claims the daughter, then he can claim "partially".

#9 is asking if your fiance has ever sponsored someone before for immigration so if he has never sponsored another immigrant he would answer "no". It has nothing to do with child support.

My understanding on the AOS is they want your AGI or adjusted gross income. Look on his tax return and find which line that is on and write that line down.

So that means he should put the gross income?

The problem with the taxes is that hhis ex claimed their daughter on 2012 and he will claimed her this year... they will take turns on it.

In that instance (where they switch off tax dependency and exemptions) you should go with who truly spend the majority on her upkeep. If you are going to be using his 2012 tax return and she was not listed on it, I would go with partially dependent and explain he pays child support if asked.

It was difficult but it definitely made us a stronger couple. :) We learned a lot about each other and we are just looking forward to being togther soon, God willing. :)
