Hi everyone,

My husband signed an I-864 five years ago for his brother-in-law who was applying for a spousal visa as his sister (the wife) was not making enough money. Part 5 (Sponsor's Household Size) of this form which we are now filling out for my AOS (from K-1) asks in Item #6, "If you have sponsored any other persons on an I-864 or I-864 EZ who are now lawful permanent residents, enter the number here." His now LPR brother-in-law does not live with us and isn't being supported by my husband, so does he still count as part of household? Do I put in a '1' or '0'? Is our household size considered to be '3' then?

I need an answer asap as we are sending this package out tomorrow morning! Thank you for helping!

I also have the same question. My brother in law whom we asked to be my husband's joint sponsor for my AOS (F2a) has already sponsored (joint sponsor) 3 relatives in the past. 2 of whom are already working since arriving in the US and 1 still studying. Will they all be included in his household number? pls. help. Thank you.

If you are still obligated to sponsor them, then they are included. Being an LPR and working does not end the obligation. It takes 40 credits, which typically takes about 10 years of working in the US to achieve > http://ssa-custhelp.ssa.gov/app/answers/detail/a_id/73/

Enter the number of lawful permanent residents whom you are currently obligated to support based on your previous submission of Form I-864 as a petitioning, substitute, or joint sponsor, or of Form I-864EZ as a petitioning sponsor. Include only those persons who have already immigrated to the United States. Do not include anyone for whom your obligation to support has ended through the sponsored immigrant's acquisition of U.S. citizenship, death, abandonment of lawful permanent residence in the United States, acquisition of 40 quarters of earned or credited work in the United States, or obtaining a new grant of adjustment of status while in removal proceedings based on a new affidavit of support, if one is required.

40 credits or until he becomes a USC. it doesn't matter that they don't live together, he is still responsible for him, has he become a USC?

are they USC? if not then he is still responsible. he must add them

Ok, i have a question, My husband an I, we dont do taxes together, we also have a child and our baby is the only one listex on his taxes return...so my question is whats his household size 3 (he, me and our baby) or 2 (listed on most recent tax return). Thank you.

How to count household size >

Your household size includes yourself and the following individuals, no matter where they live: any spouse, any dependent children under the age of 21, any other dependents listed on your most recent Federal income tax return, all persons being sponsored in this affidavit of support, and any immigrants previously sponsored with a Form I-864 or Form I-864 EZ,
