Hi everybody,

Before posting my question, I thought of introducing my case. My husband is an American and I am an Indian. We met five years ago and got married last year in India. He has been working in India for more than a year. His Indian visa expired last week and he have left to US. We filed our I-130 petition in New delhi on 16 sep 2013. They accepted our petition. On 20th september, we received email from Delhi consulate that they have sent our case to Mumbai consulate (since I live Chennai) and asked us to wait. On 10 Oct 2013, we received an e-mail from mumbai consulate that my interview is scheduled in mumbai on 6 Nov 2013.

My concern is, I have been reading about the I 130 process online. We have not received any package 3 forms to fill. Should i go ahead and fill it or should i wait for them to send it to me ? Any information on this would be of great help. I am very confused and nervous about it. Thank you!

I'm not Indian, I'm Italian, I had my interview in August but I didn't receive any package 3 neither. I just received an email (I think it was package 4) with the date of the interview and all the documents that I need to carry with me (basically only 1 more document 'cause the one I sent to the NVC few months before expired in the mean time). Then few days later I was told that the medical examination was the day before the interview. That was all for me.

- Interview at the consulate in Naples, Italy in August 2013

- In the US since November 18th, 2013

- Green card in my mailbox on January 9th, 2014

Your husband will need to complete an I-864 (Affidavit of Support) along with the applicable documentation and this will need to be taken to your interview.

As for the DS-230, you need to check with the Consulate to see if you need to fill that form out or complete the DS-260 (the online version). The DS-230 has been replaced by the DS-260 for cases that go through the NVC but I don't know if that extends to DCF filings or not.

hey minu .. didnt ur husband file the petition in USCIS ? thats strange ..i heard that only USC can file the petition in US but accordign to ur post you guys filed in delhi ..how come ?

It may vary by consulate, but I am doing DCF through Seoul and had to do the 260 online. You bring the printed submission confirmation form to the consulate when you do the interview.

Met in Canada, both moved to South Korea to be teachers! ❤️

Hi,

Apologies for the delayed response

We initially filed the petition in USCIS. Once we came to know about the 9 months processing time, my husband contacted the consulate to find out ways to expedite the process. They informed us that Delhi consulate processes I 130 petition but it depends on certain requirements. Since my husband has been working in India we met the basic requirements and got our petition approved that same day (after lot of hassles and tension).

Also the point to note is there are embassy specific rules and requirements. Not all Us embassies follow similar DCF process. There are only few US embassies around the world that have been given the right to process I 130. In india, only US consulate in New Delhi is allowed to process I 130 petition.
