My British husband came to the US around 2 years ago on a marriage visa and now has a green card and the ability to work in the US. However, he has become very homesick and wants to visit the UK for Christmas. Would going back to the UK so soon after coming over to the US somehow void his marriage visa?

If so, is there a way he can go back to the UK as a holiday? Does he need to upgrade his visa?

Any and all help would be greatly appreciated! Thanks in advance!

He can go visit the UK for a holiday. smile.png That's no problem at all and it won't effect his standing in the USA or his green card (I assume he has the 10 year one?).

If he wants to stay outside of the USA for a prolonged period of time (like 6 months+), then there are papers you need to file for for re-entry, but that does not sound like what he wants to do.

His marriage visa is technically already void - that would have expired as his temporary green card after a year - his physical plastic green card is all he needs to re-enter the USA now (with his valid UK passport, naturally).

I'm going to the UK for 3 weeks October/November and I only entered the USA to live in July. smile.png I hope his trip helps with his home-sickness!

His 'marriage visa' was invalidated when he hit USA soil, that first time.

However, he has a green card and U.K. passport, so the rules for getting in/out of the USA are dead easy, for him.

He can be outside of the USA for up to 6 months continuously without further DoS/CBP action when coming back into the USA.
