Hi everyone, I have married a Palestinian man from Lebanon on June 7, 2010, and he was granted a CR-1 visa and came to the US on August 24, 2012; However, he has not been living with me ever since he came here (he has been living in TX and I have been living in CT). We are not getting along anymore and I would like to withdraw, if possible, myself from this relation and probably claim fraud in the marriage from his behalf. Do I write a letter to immigration stating we are not together? and what are the consequences if I do that; because honestly I do not want him here.. I feel betrayed. Thank you Everyone.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

He is still a CR1which means he still has conditions. I'm surprised that immigration hasn't come to pay you a visit. Just from experience immigration will send you thru loops. I tried with my ex and they told me there was nothing they could do except take a report.

It didn't work for me but it may work for you.

Hey there renee, Thank you so much for your reply; however, I think that in order for him to remove the conditions; he has to have solid proof that he was living with him, I mean that's the entire idea of granting him visa to come here. Therefore, it can lead to his termination if they find out he wasn't living with me. I can also simply not go with him to the interview and have them terminate him automatically. I also want to tell you something though; becareful of men out of the country I mean people from the same heritage get cautious about marrying people and making papers for them, never mind people from other cultures. I would say that most Arab men marry to come here, So listen tell him that if he wants you then you should live in Algeria. Just becareful, because I know how Arabs are ok sweety don't get your heart broken.

They will not remove him, but you can report write a report from your side and what has happened.

He will still have to remove the conditions and while removing the conditions if USCIS can prove the marriage was fraud and was only for the purpose of immigration based on proof and letter you provide, he might not be allowed to complete the AOS that rarely happens though.

File for divorce and move on with your life. Do not worry about his immigration status. That is his problem and he can file for removal of conditions (ROC) after the divorce, but he will have to prove that he entered into the marriage in good faith and not to obtain a GC. You can write the USCIS a letter stating why you think the marriage was a fraud, but they will in all likelihood see it as a scorned wife venting unless you have solid proof.

He can file for ROC without being married to you. There is little you can do that will affect his immigration status--that is his responsibility. You need to live your life and not worry about him. Divorce and move on.

I say go into your local USCIS office via an infopass appointment,

and ask for the FDNS officer when you are there.

also, search on 'FDNS' here , using the advanced search tool on a PC.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
