K-1 expired. Options?

Hi everyone,

Let me cut right to it. My fiance received her K-1 visa in May 2012. Well we didn't use it. She never entered the country and we didn't apply for any extensions. Now in August 2013 we are ready to pull the trigger. Is there any way to re-validate this visa? If not, would the best option be to marry abroad and just apply for a different visa type? I am working stateside now and she is in Dubai.

What are my options? Any help you all could provide would be highly appreciated!

Email the Embassy and ask.

Most likekly will have to do another visa petiition all over again.

You can do whichever path you like. You can start over with the I-129f for K1, or get married and submit the I-130 for CR-1. Not using the old visa shouldn't matter (although they may be curious as to why at her interview).

It is possible they'll reissue the visa, but I think it unlikely given how long you've waited. Always worth asking, though.

12th January 2017 - Biometrics (again)
30th May 2017 - Interview (approved)
7th June 2017 - Oath

Timeline

You can always get married and file for CR1 for K1 I believe your will have to refile the whole thing, I don’t think there is a way to reissue the same K1 but I could be wrong. Check with consulate and they might be able to give you a better option if any available.

Now you said I remember reading about it, yes someone did get their K1 stamped again but I do not remember their situation.

I got my K-1 visa on July 19th and it expires in January 10th, so it is 6 months. How come her visa expired which was issued in May? Is it different in her country ?
