Hi everyone,

My wife's interview date has been set for next month in the Mumbai embassy location. Just found out I was downsized/fired. I'm not sure how this will effect the immigration process. She has to present the entire AOS at the time of interview according to the interview letter.

How do I proceed? I have enough savings to support her for as long as it takes to find new work and will also be eligible for unemployment benefits. Do I give her an updated AOS form with a new primary sponsor & i become the joint sponsor?

This is a cr1 visa.

Any advice would be very much appreciated!

You, as the petitioner, will always be the primary sponsor.

What you need to get is a joint sponsor.

thanks for the response, so I should give my wife a new AOS I864 form with joint sponsor information to present at the interview? I inititally sent a AOS I-864ez form to the NVC. Even though the form had a minor error (forgot to "NA" one field), the NVC sent the DS230 along to the embassy and according to the interview letter, the NVC didn't send the AOS to the mumbai embassy. The interview letter says I should present the complete AOS.

I got checklisted twice for the AOS. First time I didn't realize I could submit the 1040 form for tax purposes and it would be equivalent to tax return transcript (I hadn't gotten my 2012 tax return yet) and the second time was the missing 'NA'. I think at that point NVC didn't want to hold up the interview over such a petty issue.

I agree, get a joint sponsor and send the updated information to your wife.

The company actually fired me the day before I am taking a 2 week vacation to see the wife. According to them, they thought it was better if I knew I had no job before going on vacation so I don't spend too much. How thoughtful of them.

For the joint sponser, I fill out a new I-864 form and have my dad fill out the I-864A?

OMG, I hate companies that do that. I guess they thought they were doing you a favor... "Have a great trip and by the way... don't stress too much about being fired while you're on vacation" UGHHHH

Have a great visit ! File for unemployment and take care of everything before you go !!! It will all work out !!

So I shouldn't fill out the I-864A for my dad as a household member?

I live with my parents but we file taxes separately (he doesn't claim me on his taxes).

I need a clarification on the I-864 part 5: sponsor household size question though.

On my I-864 form, I count the principal immigrant (my wife), myself. If I'm ignoring the fact that I live with my parents, the total household size would be two (2).

On my dad's I-864 form, He should count the principal immigrant (my wife), himself & his wife. Also, does he need to show citizenship via copy of passport, etc?

Is this correct?

Your household side is you + immigrant

another question,

so my current income in part 6 Sponsor's Income would be $0 OR should it be how much i've earned till I got fired (I can show paystubs that show I made over 125% over poverty line)? Also, should I include any assets (savings & stocks) if I'm going to use a joint sponsor (thinking I should leave the section blank to avoid complexity)?

Your current income is $0 if you are not currently working. Don't lie or try to skirt around it. ;)


And to be honest, unless you can use enough assets to pass the threshold, I wouldn't bother.
