My Friend is trying to file a K-1 for her Fiance in Panama and she is considering filing Bankruptcy Ch 7 or Debt Consolidation Ch 13 will this affect the I-134 or I-184 when change of status w/ co-sponsor?

I would appreciate anyones feedback that has filed for either of these or knows about this subject.

Thank you fellow VJ's

Debt is irrelevant. Bills are irrelevant. Only income matters.

So no, neither the I-134 or the I-864 are affected by bankruptcy.

On a personal note though, it would be best that the immigrant keep themselves financially separate from USC until it's been dealt with lest it negatively affect them. The problem with that though is financial co-mingling is one of the best kinds of evidence. That said, of course debt would negatively affect the immigrant. So I would keep separate and simply explain to USCIS (if requested) why you were separate. They would not hold that against you as it makes the best financial sense. You can still be on bills together, have your address the same, etc etc.

Yea I think that is best keeping accounts and things separate for a while. But as long as things are getting paid and there is money in the accounts, I don't think that will be a problem for her.

This filing is not important to USCIS, like the other have said and if Vanessa & Tony comment they are almost always right. It has nothing to do with your filing. However please keep any paperwork handy in case they ask but other wise you are clear for landing. I filed chapter 13 because of the cost of my divorce and I thought it was a great way to go things worked out fine and mine took only about two months and was easy. Wish you the best

Yes it could but it depends on the timing, country and CO.

Think about it.

You're trying to convince the government (DOS) you are solvent and can take on at least one foreigner while you've also asked the government to bail you out and to qualify for BK you would have submitted paperwork to show that you're insolvent, mostly.

Good luck.

She has student loans so I'm sure she will be okay. Thank you for your opinion.
