Question for I-864 ,Mother sponsor for son with 0 income

I am American citizen based on marriage to U.S. citizen.
Since my marriage, my son has been living in Thailand with my parents. Now he is here with me with six months Visitor Visa. I want to apply Green card for him. He is 15 years old and his father lives in Thailand and he is Thai citizen. I was not married when I had my son. I came to US with Fiancé’ VISA and married my husband.

I want to prepare all the documents myself so I need your help on making sure I file right forms:

I -130

I- 485 part 2. I check a. It is correct?

I- 693

I -864

Question for I-864 I worked as a part from 10/11-06/12 right now I don't work and don't have income but my husband work and he have enough income we are joint tax return.

Question: In part 6. I check 4. Unemployed since 7/1/2012

5. My current individual annual income is `$ 0

Income you are using from any other person who was counted in your household size:

6a .I put my husband name

6b. Spouse

6c. His current income

10. I put my husband current income

11. I check X

13 I check X

13 a, 13 b, 13 c I put my husband income Tax

Please some one helps me this is a correct?

My husband should to file form I 864 or I 864A?

The child is here on a tourist visa so he must have been allowed to leave Thailand. How was that permission obtained? This may become a huge question in the future. I hope its as simple as the father helped obtain the visa.

At some point the custody of this child will become an issue. If you don't have the fathers written permission or a Thai court order there will be a problem.

I would make sure about these issues first then proceed with the other items.

I already have his farther letter of Consent to my son to emigrate to the U.S. permanently without any conditions. With his Thai ID. He went to signed at the office district in Thailand . Then then translated the letter to English . I hope this is will be fine for cover the consent form my son’s father.

That is very good news. But how will you explain that if asked why the child came on a tourist visa? Of course I want this to all go great but there may be questions about all of this that you need to be prepared for.

I maybe totally off base here, but since she's a citizen, can't she just file for citizenship for her son?

Son needs to be in possession of proper immigrant visa, and he is not. Once he gets the GC he will then also be a citizen.

That is a very interesting question. I didn't even think of that angle. I am happy to find the child is here and the O P did a great job in getting this permission letter in advance. I haven't seen this done before.

I myself am working on my citizenship and found that to get my daughters citizenship I only have to apply for a U S passport for her after I am a citizen. When she gets the passport she becomes a citizen!

I am interested to see what is required, if anything, to convert the childs status from tourist to citizen. My daughter entered with a K 4 so I think its handled differently.

My son came to U.S.A . as a tourist visa last year then go back to Thailand but This year he come to visit me again and he want to live here with me in U.S.A. He happy to be here and love me and I love him want to take care of him .He will have a good friend and a good life here with me.This is my answer .

Do you and your husband not file taxes jointly? You would list the total income amount from your joint taxes for #13. Otherwise you list the total income from your tax returns there. You are filing the I-864. And yes, you enter his current income again in #10 and check #11. He needs to provide an I-864A and his supporting documentation.

You are filing the I-864. And yes, you enter his current income again in #10 and check #11. He needs to provide an I-864A and his supporting documentation.

Hi Jay-Kay ,Thank you for your answer. Yes, I file taxes jointly. I did everything same as you wrote I hope everything will be fine.

Well they obviously had intent to immigrate on a non-immigrant visa, which is illegal. But intent by itself is not enough of a negative factor to deny an AOS, but they may have other negative factors.

It could also be possible that the son was visiting and then afterwards they've decided the son should stay with this mother. I guess the dating of the letter from the father would identify intent or not to the USCIS.
