I HAVE HAD ENOUGH I WANNA KNOW CAN WE REFILE AGAIN I MEAN SEND A NEW PETITION TO THE USCIS SINCE IT MAY BE THEY HAVE LOST OUR CASE OR MISPLACED OUR FILE. CAN IT BE DONE LIKE THAT SEND A NEW CASE? THIS IS REALLY TEARING ME AND MY PARTNER APART WE HAVE WAITED SINCE JULY 2012 FOR JUST A NOA2 TO MOVE STEPS TO THE OTHER SIDE OF US COMING TOGETHER.

I'm so sorry to read this. I can't really imagine your situation.

Have you contacted your congressman? call to a tier2? ask for an info pass?

Nope..don't do that..Just contact ur Congressman, Senator, or whoever u think that can help u with ur case..Have u tried infopass?..

We almost resorted to resubmitting a new petition after a year of not hearing from our case but i don't think it will do good not unless USCIS asked u to do it..

NVC Case Number -- 05/14/2013

Try the Ombudsman > http://www.dhs.gov/ombudsman-case-assistance

And call the USCIS and ask to speak to a tier 2 immigration officer to tell them how long it has been and put in a service request.

If you withdraw your current petition and then refile, you will start all over again with the waiting for months.

Are you on top of those people or simply sending off an email.? At this point for you, the squeaky wheel gets the grease. Call them often. Email more often. Stay on top of it until either they say, yes refile because your case is lost and we will get it through ASAP or find your case and get it through ASAP.

If you contacted the National Customer Service Center with a case-related inquiry and more than 30 days have passed and you have not received a response, you may email the appropriate USCIS Service Center with your inquiry:

California Service Center: csc-ncsc-followup@dhs.gov

If you do not receive a response within 21 days of contacting the Service Center, you may contact the USCIS Headquarters Office of Service Center Operations by email at SCOPSSCATA@dhs.gov
