I have a question regarding the I-134. Question #7 asks what my annual income is.

I'm a little confused what to answer here, as my income from week to week fluctuates. I am a full-time employee, but one week I may work 40 hours and the next 90 hours so I really am not sure what my annual income is yet. Attached to my I-134 I have last years tax return. I only worked 1/2 the year but since then I have received a sizable raise per hour. There is no doubt that I will make over the 125% this year (I have the copies of pay stubs to prove so.) I guess I'm just confused on what to answer there along with the fact I was 300$ short of the new 125% put out this year but only because I worked half of the year. My tax return states this, so I'm guessing I should probably just go with a co-sponsor. Otherwise I'm going to be pretty worried about getting the I-134 approved.

I am confused about the same thing, my fiance i paid per hour, and made enought all of the years, but wasn't working full last year so he made around 25 000 instead of around 35 000. should i put income as calculated hour rate x 40 hours x 52 weeks, or just what he earned last year?? And how to put up a employer letter, how should i state annual income???

Your income is listed on your tax returns and on the W2 form or 1099-MISC form from your employer. Also, do you have 6 month's pay stubs? All of that is proof.

CITIZENSHIP: 

Biometrics appointment for 2020-03-27 has been cancelled until further notice as all field offices are closed because of COVID-19.

***NOA dated 12/10/2020 USCIS stated they are able to reuse previous Biometrics***

Interview was easy. My hubby's Oath Ceremony is scheduled for February 25th. I can't watch >sad< but happy he is getting his certificate!

That's where I'm confused. Last year's tax transcript and W2's state and income of 19,020 - a shade over 300 lower than the 125%. But this year, by calculating the hourly rate x 40 x 52 I will definitely make more than the 125%. So if "they" look at last year's income I don't qualify. But if "they" look at my 6 month's worth of pay stubs from this year they will see proof that I am on my way to earning over the 125%.

What we should do with I864 when it comes to the years that we didn't earn $19388? Right now it fits, earns double the poverty guidelines in 2013, but can't state in employer letter the amount he will earn but what he earned in 2012.

The employer letter can state his current wage and hours worked per week. A pay stub is also good. You have tax returns to show previous years' income.

He is working way overtime and saturdays, is is possible to add that? Or should I just put his pay rate is $xx and weekly he earns $xx plus bonuses. I don't know if he made enouht income for the past year, so i was wondering if one year is above guidelines in I-864 should we find a co-sponsor?

Everyone keeps saying that current income is what matters, and you keep asking "but what about last years' taxes?" I don't understand why that is your response. What is not computing?

You can't use overtime and the like because it is not guaranteed. Use the guaranteed salary for this year, based on what an employer can vouch for you. An employer can say that "X person works for me full time and makes X a month" but an employer cannot say "I can guarantee overtime and extra special projects that pay more."

USCIS goes by current income, but you need to prove beyond a doubt what his current base income is - the amount he is guaranteed to get if he continues working. Your prove this by pay stubs and a letter from the employer outlining the job, wage/salary, and hours.

If you must know, I asked because on the instructions for the I-134 it states to attach a copy of last year's tax return. I was unsure why this mattered if they go by your recent earnings.

If you have something useful to add then do so. Otherwise don't bother posting on this thread. Your attitude is unnecessary.

It is just to get a whole picture of the situation, especially for people who are just over the line or whatever else. It is also really the only way to get a reliable picture of those who are self-employed, because your income if self-employed, for AOS purposes, is the income minus expenses you are claiming (so your actual take home income). That is something very easily shown on a tax transcript.

It is still just the current income that will be the deciding factor in 99.99% of cases.

The I-134 will probably vary by consulate, so I can only give you my experience with Colombia. I sent in with my I-134 my last 3 years tax return transcripts, all were under the poverty level. I also submitted employment letters, and paystubs from 2 full time jobs that proved my income was over the poverty level. They accepted my I-134 without co-sponsor and approved the visa.
