Hello. I am looking for some answers in regards to my submission of the I-134, affidavit of support. Any help would be greatly appreciated.

I've seen both that a K-1 visa sponsor needs to meet 100% of the poverty guidelines and 125% of the poverty guidelines. Which is it?

If it is the 125%, I fall 300 dollars short of the required amount for 2013. I was only working half of 2012 and my situation has greatly improved with a sizable hourly pay rate increase and 3 promotions in the NYARNG. That leads me to another question. I realize the National Guard is not considered active duty time, but we are in a drilling status that of which I am curious to know if on the I-134F I would be considered "active duty military." That would put me back in the parameters of acceptance to sponsor my K-1 fiancé.

With all of that said, if I am not able to sponsor my fiancé on my own, how do I go about getting a co-sponsor? I have one lined up. My 2 questions with that are, #1 do we have to live in the same house and #2 do we both fill out the I-134?

And finally, what do I need to send in with my I-134? I've seen so far that I need a copy of my tax return, letter from my employer, and copy of bank account withdraws and deposits along with date of bank account opened.

If you are on Active military duty, then ur poverty guideline will be the 100% otherwise it will be 125%. If you fall short of the 125% if you fall under that category, then you have to get a sponsor. To your question #1, your sponsor don't have to live at the same house as you. To find out if you are on active duty , i suggest you call the NVC and ask them. That's all i can help you with..hopefully you find your other answers soon!!

This is what I have heard. You need your bank account statements from six months ago, your pay stubs (W2), letter from your employer, and if you are falling behind you have have your parents as your co-sponsor if they are willing to help you. I am NOT an attorney, this is something info I have gotten from a paralegal. Make sure you print out COLORED copies of your bank statements and perhaps checks that have been deposited. Your bank statement will state the "Average" amount of money coming into your account. IF you have any sort of savings account, you may also get that balance and have it notarized or a bank statement will be better.

Thats what I am going to do when I get approved. If you are going to add your parents, you can have (2) I134 Affidavit of support listed. They also need to provide the documents, etc.


Once again, I am NOT an attorney , and this is something my friends have used for their petitions.

Let me clarify the confusion behind the 100% and 125% guidelines for the I-134. Even though the requirements state you only need 100%, for a K-1 visa most consulates are going to require 125% BECAUSE of the intent to immigrate. The 100% guideline is designed for non-immigrant cases where the visa holder would eventually return home. Even though the K-1 visa is classified as a non-immigrant visa, it is treated like an immigrant visa because the visa holder will more than likely stay in the US after marriage and adjust status.

The I-134 does not work the same as the I-864 and K-1 applicants do not send anything to the NVC, so they would have nothing to do with their affidavit of support.

So, you have taken your gross annual income amounts, how many hours worked a week times your hourly pay rate then multiplied by 52 weeks, and it falls 300 short of the 125%? Do you have any assets to make up the small difference?

If you need a co-sponsor, they can be any USC or LPR residing anywhere in the US. They fill out their own I-134 and provide most recent tax transcript, letter from employer and recent pay stubs, same as you provide. They should also include proof of being a USC or LPR.

I have not multiplied my hourly wage by a normal work week by 52. I was under the impression I had to make that 19,xxx during 2012. I started working full time in June, so if I did the math I would obviously make over the 125%.


And yes, I have the assets to make up that difference.

It is not based on past income. Your current income is most important and that is what you list on the I-134 where it asks for your current income. The letter from employer and recent pay stubs are used to prove that current income amount you list. List your assets and provide proof of those too along with your most recent tax transcript. I do not believe you need a co-sponsor if you are earning above the 125%.

125% is the requirement. If you current income has increased since 2012 (tax return) provide evidence of this and there should be no issues. Not sure about the active duty, are you full time "active" with the National Guard? Is all your income from the NYARNG?

If you use a co-sponsor they complete the I-134 as well along with all the required supporting documents. No you all do not have to live in the same house.

If your income alone meets or exceed the 125% requirement you do not need to submit bank statements or list other assets.

If the income alone meet or exceeds the 125% requirement of the I-864P poverty guidelines bank statements are not needed (color copies or otherwise), do need to include tax return, W-2, pay stubs, letter from employer.
