I am getting my I-134 form filled out and have a question on the w-2's. I have my w-2's for 2012 but can not find my 2010 or 2011 ones. I have copy's of all three years tax returns on my computer I can print off. Do I need the w-2's for 2010 and 2011, or do I need to call IRS and get a transcript for all three years now? Thanks for any help I get.

The easiest is to get the tax return transcripts from the local IRS office. If you have one nearby, or if you can easily go to a local office in person, you can get your transcripts the same day. Or you can mail for them, which will take a little bit longer.

i suggest tax transcripts. For the I-134, it's either / or - either full tax return copy or tax transcript.

Can order tax transcripts online or via telephone

but if'n you need them fast, same day, walk into yer local IRS office and get them there.

I too am filling out my I-134 and looking at the wording "Please submit Form I-134 signed by your petitioner. The form should be accompanied by evidence of sustained income or financial resources, such as his/her most recent tax return."

My 2010, 2011 and 2012 tax returns show negative amount for my AGI (Adjusted gross income). I have business losses (Rental Real Estate) and since was in the business of Real Estate I did not have a limit on my Rental Losses, therefore a Net Operating Loss, hence a negative amount for my AGI on tax returns. I just started a new W2 job that pays 3x or 4x the federal poverty guidelines for a family of two (me and future wife).

So to the point, based on State Departments website: Applicants presenting Form I-134 will need to show that their U.S. sponsor's income is 100 percent of the federal poverty guideline.

My current job meets that requirement but was worried about the wording on P4 about sustained income? I assume a job with a company is proof of sustainable income, wanted to get others thoughts.

Include a letter of employment from your new job stating your annual salary, and try to include as many pay stubs as you can. Your proof of current income has more weight than your past income as evidenced by your tax returns. They want to see if your CURRENT income is sufficient.
