So i contaced my senate about my K-1 visa and how VSC is slow and he replyed saying..

Thank you for contacting our office regarding your case. Although our office cannot guarantee a particular outcome, I want you to know that we will do our best to help you receive a fair and timely response.

To begin the process, under provisions of the Privacy Act of 1974, federal agencies require us to obtain a written and signed release when making an inquiry on behalf of a constituent. The enclosed (or attached) privacy release form must be signed by the person directly affected, unless that person is a minor. The form must be returned to our office as soon as possible either by mail, email, or by fax. Please do not send this form to any other office as that will result in an unnecessary delay. Once we receive the release, we can begin to work on your case. If your case involves medical or health-care information, our office may ask you to complete a release specifically authorizing access to medical information necessary to resolve your case.

Please remember that under the law and the rules of the United States Senate, our office cannot:

• force an agency to expedite your case or to act in your favor;

• offer legal advice or recommend an attorney;

• get involved in matters under the jurisdiction of any court or legal entity;

• intervene in matters under the jurisdiction of a school district, your local government, or the state government.

If you want your Senator's office to be able to talk to USCIS about your petition, then you need to sign the privacy release. Without the release, privacy laws prevents USCIS from discussing your case with the Senator's office.

All the Senator's office has limited abilities to help you. It can inquire about your case and see if it can get moving along. You can see the list if things they can't do.

Yes, I faxed them the release form yesterday..

You contacted your senator's office prematurely if your timeline is correct. The wait time for a K-1 is at minimum 5 months so you haven't gone past USCIS processing time yet.

I contacted them because i have seen many february approvals that are past my date and im still waiting, so its kind of unfair to see that when you have filed before them.

Are those being contacted file in the same office as you?

Each case is different, some cases are processed before others, and they don't process FIFO.

I'll give you a little advice. In this journey (from k1 to AOS to ROC to Citizenship), there will be waiting and more waiting. You need to learn how to relax and let the process work itself out and not freak out. Otherwise, you will drive yourself and others around you nuts. And you are at the very beginning, so you have lots of waiting to do still, so find a hobby or something to keep busy and not worrying over this #######. Don't be one of those people who checks daily if their case has been "touched" or calling and harrasing CIS or NVC on a daily basis. It's just sad when people don't have anything else going on in the lives besides imigration.rofl.gif

Unfortunately, there is nothing that's "fair" in this process. The USCIS will process cases at random, not according to date filed. All you can do is wait. Check out other VJ'ers timeline to get an idea (mine included) of what to expect.

There is zero logic to how cases are processed. I have contacted my Senator and Representative, and even the President, imploring them to revamp the antiquated system. My Congressman's office agreed that the Dream Act appears to have overloaded the USCIS and impacted the K1 processing times. I have reiterated to all three that K1 filers CHOSE to follow the proper Immigration Laws rather than marrying while the Beneficiary is on holiday here in the US. Does contacting your US Representative/Senator help? It is debatable if you are within processing times. I am frustrated, but I will never give up.

Thank you! I had to force myself to stop looking at the CSC Igor's List because it made me sad to see them moving on to February. Hey! I noticed you weren't able to see your case on the USCIS website until your approval date. We keep checking ours and it still says "case not found". I know that one day soon we will suddenly see it say APPROVED, as you did in April. I can imagine the tears of joy you felt when you saw that! I will scream so loudly when that happens, that all Texans will hear me! dancin5hr.gif

thanks for the good thoughts, but my stupid case is still stuck at that office and I am trying everything I can to get it out of there.

about your case not showing up online, the only good thing about that is that the cr answering the phone at uscis can only see that as well, so any questions you have will be routed to an IO

good luck, hang tough
