Hi everyone,

I really need some advice and i want to thank you all at the beginning for all your possible suggestions.

I am a Turkish citizen, living in Turkey and having my MA degree. My fiance is an American citizen, teaching English in Turkey. We want to get married this summer but we are confused because of all these complicated visa processes.

We can get married (legally) in Turkey and then we can file for a spouse visa I guess. However, until i receive this visa, if i didnt understand wrong, i cannot enter the US, is it right? (Currently i have a 10-year tourist visa). The problem is that i will be applying for PhD programs this fall and i really want to enroll in the graduate school if i am accepted and i do not want these legal issues to prevent me from entering the US and continuing my education.

Another option is to enter the US with my tourist visa and get married there, then return to Turkey without filing any petitions. However, in this case, can i re-enter the US? Moreover, i guess i cannot apply for a student visa, even though i have not started the spouse visa procedure, did i understand correct?

A third option seems to be aplpying for a fiance visa. However, i do not know if that procedure would be finished until August or October the latest, when we want to have the wedding. On the other hand, we have to return to Turkey after getting married because my Fiance has a work contract at least for one more year and I have to finish my thesis with my adviser. So, if we receive the fiance visa, get married in the US, would they allow us to return to Turkey to stay at least for one more year?

Your answers to my questions mean so much.

You can use the tourist visa to enter the USA during the process.

However, it MAY be more difficult to get a F1 student visa if you are married to a USC

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I think once we get married, the only visa I can apply is the spouse visa. I cannot apply for a student visa. So, thinking the risks of entering the US with a tourist visa, getting married there and returning to Turkey, i guess it would be the best for us to get married here and start the procedure here. My only hesitation would be not being able to enter the US to enroll to the graduate school but hopefully they would not drag the situation that long.

If you get married now, you will not have your spousal visa by fall to enroll in grad school, it takes about a year from filing through interview to getting the visa.

If you get married now, you will not have your spousal visa by fall to enroll in grad school, it takes about a year from filing through interview to getting the visa.

I am thinking of applying this year and starting the grad school next year, in 2014 - 2015 fall semester.

In that case, your best option is to get married asap and file asap for a CR-1 visa. Congrats and good luck :)
