Hello, when I was 10 years old my last name was changed. This was never done legaly, so there are no paper work on it. But all these years I have gone under my new last name. My school records, military records, drivers license and passport are with this last name. However, my birth certifcate is under my biological last name. Is there any thing else I can use other then that to show proof? Or do I need that birth certificate? Will this cause me a problem? Thanks!

Yes, it will cause you a problem. Due to today's laws on identity fraud, and identity theft, it is illegal to use a name that is not legally yours to use. Regardless of the age of the beginning of the use. You will need to contact a lawyer, to get your name legally changed to new name. Or to legally change your life documents back to your original name. You will have problems when it comes to the background checks.

How was your name changed, because your parents or legal guardians cannot just arbitrarily change your name.

Well my names was changed back when I was in the 4th grade arounf 1977 or so. It was never questioned they just did it. Now even my social security number is this last name. Everything is except my birth certificate. I have had background checks before when getting jobs and they were pretty thorough because it was done by law enforcement and I have never had any problems. I was just wondering if there is another thing or way I can do it like just use my passport. I heard I can, but not sure.

How in the world did you get your passport under a different name than is shown on your birth certificate, if you don't have any records of the name change? Something isn't right here. At some point someone, maybe your parents, HAD to show name change in order to get your first passport and SSN.
