Time Line: For a Friend of Mine.

US citizen. Married to my sweetheart in Nigeria

Filed the I-30 for spouse who is in Nigeria. (Married)

April 29th Receipt arrived.

Filed up form for I-129F --K3 confused on the fee.

Can someone explain this to me please

"The filing fee for a Form I-129F is
$340.
What Is the Filing Fee
There is no fee for Form I-129F petitions for K-3 (non-immigrant)."
Does this no fee apply to me: Please help clarify.

Nov. 16 2005, Wife received visa based on sepearate K3 filings.

Dec. 15, 05.----Wife arrives in US on a K3 visa.

Jan. 15, 06--- AOS filed with USCIS.

Jan. 22. 06----USCIS entered the receipt.

March 14,06-- Passport and fingerprints taken

May 18, 06, --- received additional info that was requested.

File the I-129F for a FINACE(E) visa. File the 1-130 for a SPOUSAL visa. Do not file a K-3 visa as it is basically dead and a waste of time and money

So your friend should file for a spousal visa using the I-130 form like he did. Information about that process can be found here on VJ using the Guides.

Moving from Progress Reports to Process & Procedures.

There is no charge for filing an I-129F to start the K3 process. However, the K3 is a visa type that current procedures at the NVC has rendered almost virutally unobrtainable; tell your freind to not bother pursuing the K3 path.

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)

They say it isn't used anymore, but they still are using them. I was trying to expedite my i130 petition the rep at immigration office at my local field office told me that my case couldn't be expedited. The only way it could get done faster was by filing a k3 visa. He gave me the i129f form to fill it out and also said it was at no extra charge for it bcz I had already file for the I 130 petition. So it could be done if you wish to do it.

I agree "not used anymore" was not the best choice of words; however, what the poster who said that was actually refering to was the K3 is administratively closed by the NVC over 90% of the time.

The provision in the LIFE act that created the K3 visa has never been repealed and thus remains on the books. Because it still remains on the books, USCIS personnel will always say its a viable path (whether or not the individual you happen to speak with is familiar with State Department policy regarding administrative closure).

And to clear up any confusion about administrative clouse, it works like this: when the NVC receives an I-129F that was filed to start the K3 process, if they already have an approved I-130 on-station, the K3 process is administratively closed. The K3 is only processed if there is no approved I-130 on-station (a rare scenario).

In some instances, if the I-129F for the K3 survives the NVC, it could still end up administratively closed by the Embassy or Consulate if they receive or get word of an approved I-130 on-station within the State Department.

Years ago an spousal petition normally took years. They opened up the K3 to provide a speedier path for USC's. The two are so close to identical that the I130 beats the K3 to the embassy. You can file it, but it normally does nothing to help the process.

This will not be over quickly. You will not enjoy this.
