Filed: K-1 Visa Country: Philippines
Timeline

I am currently living here in Maui Hawaii, my future fiancé Michael is in the Philippines. I filed for K1 Visa I129-F and receive NOA1 February 06, 2013.

My concern is, I am moving back to Seattle with my main family this coming June 13, 2013 and I was planing on switching the address over there. However, within that three months that he is here our plan is to get married here in Maui Hawaii. I am not sure if that is okay for him to travel around while having that 90 days grace period to stay before we get married. From my understanding, If he was to get approve hopefully just like the VJ Timeline it says around September so were looking at arrival around December?

I am praying that when that time comes we are already set in our heart that we want to get married in Maui Hawaii were most of our family are. Can someone please help me clarify all of this because I am not sure if it's okay for him to fly back to Hawaii and we can get married there then back to Seattle, WA. Unless, wherever he originally landed that is where were suppose to get married? I am sorry if its confusing because even I don't know how to explain it well.

Thank you so much, I really appreciate all your help.

I might be a bit confused but if i got this right: when he visits, your K1 won't be processed and you plan on getting married anyways? That is immigration fraud and you can't do that. If you are approved and he has his k1 visa, you have 90 days from his entrance into the usa to get married.

I believed as long as it's a straight flight to and from mainland to HI he'll be okay. Wait for the experts to chime in

You want to get married before you have your K-1 in your hand? No, you cannot do that. You will be banned from the US for life, and yes, it has happened.

The K-1 is for marrying in the US only, after you have the visa in your hand, within 90 days of entering the US. You cannot enter the US with your K-1 visa if you are married.

AOS for my husband
8/17/10: INTERVIEW DAY (day 123) APPROVED!!

ROC:
5/23/12: Sent out package
2/06/13: APPROVED!

If you meant:

Michael receives his K-1 visa later this year, arrives in Seattle, and you both travel to Maui to get married within 90 days of his arrival in the US, then that is perfectly fine. You don't have to get married in Seattle.

I think you didn't understand but I appreciate the reply please do take the time to read it again :)

It is when he already pass everything in the Philippines and on his way here to US. We are not getting married until he gets here that is why I filed for k1 visa. However, We plan to get married in Maui Hawaii US which is a 6 hour flight from Seattle which is also in the US. We just wanted to get married there and not in Seattle then fly back to Seattle when were done with everything. :) I hope that make sense

I know its confusing because a lot of people don't consider MAUI HI as part of the US. Unless you read it again and fully understand that our intention is to get married when he received all the approval upon getting here. Prior to that we just decided that no matter where I moved too we just want to get married in Maui where our family is that is when he gets here from the Philippines. No fraud or whatsoever is intended I am just wondering if its okay for him to travel while in his 90 days before we get married. Thank you for replying though I appreciate it :)

Thank you, yes it will be from Mainland to Hawaii. I am just concern if we are able to do that then back to Mainland after we get married in HI. But first I just want his papers to get approve. If it's Gods will everything will just fall into places. I appreciate the reply thank you

After getting married we plan to have our Honeymoon there and stay just for a little bit then back to Seattle to start our life together. :) I appreciate the help I really hope that it gets approve soon.

The other poster was absolutely correct. Once the beneficiary has the Visa and enters the US, they can then travel throughout the US without any restrictions. You can get married in Hawaii, Florida, Alaska or wherever you choose within the US. The only travel that is not allowed is travel outside of the country. If he leaves the US before he gets the proper documents, he will not be able to re-enter the country until he has his green card or he gets travel approval, which can be applied for when adjusting status.

Good luck to you and I hope it all goes smoothly.

I agree with the post above mine. You can travel anywhere in the USA and get married anywhere in the USA. If you travel internationally, you will not be able to re-enter the US without AOSing first. DON'T connect through Vancouver, BC!

Domestic travel is 100% ok. Some folks get married in Vegas, or elsewhere; Hawaii is perfectly acceptable. Just don't go anywhere that would require YOU to have a passport.

It is totally ok to travel within the U.S. when arriiving on the K-1 visa. :) As others have said, just make sure to not have a layover out of the country.

I hope you have a beautiful wedding and honeymoon in Hawaii! My husband and I had our honeymoon in Hawaii. It was lovely. :)
