Hello all, I just wanted to follow up and let the list know we received the hard copy RFE today, 10 days after the first email notice. Interestingly enough as well I had received a second email notice of the RFE four days after the first, and the hard copy is dated on the second notice. So it might seem they email you about it before they actually print and send the form.

Now on to what they needed. They claim the requirement that the petitioner and beneficiary have met in person in two years was not met because the photos did not contain time stamps on them. Then they go on to tell you other items that would help as the primary evidence. The sad part is that we sent in all of my plane ticket receipts as well as copies of the passport pages that showed the entry and exit stamps. We even included some credit card copies of the hotel receipts. So how they think the photos are outside of the dates of those travels is beyond my comprehension. It almost sounds like they lost a part of our package of information.

So we'll re-gather the items and I already found a good free program that takes the EXIF data from the jpg and will recreate the photo with the date stamp on it. Good luck to all, I hope we'll be notifying you of the NOA2 within the next month or sooner.

oh geez, posts like this make me worried. I didn't have any time stamped photo's. My primary evidence is the boarding passes that we met 2 times and I actually stayed with him for 6 months. Let us know what happens!

now i am worried too, just got my RFE hardcopy and they are asking for photos with date and time. Digital photos don't print out with date and time but the cd of the photos when you click on the photos does give time and date as well as camera information.

On my RFE it says not to include CD????

Anyone know how to print out digital photos with the date and time on them?

I thought photos were supposed to be only secondary evidence! Hmmm...



None of my photos were date stamped, and I didn't get an RFE. I guess the rest of my evidence must have been pretty good.

If you need a free ware software to re-do your photos, I found this one that worked well for me. It's called FastStone Image Viewer and you can find it at www.faststone.org. If you can't figure out how to get the EXIF date stamp on it, private mail me, it does them as a batch processing, so quite easy to do.

We did not individually write on each photo, as I didn't think it was really needed since we sent in the plane tickets and passport stamps showing my trips with dates. It is a shame the government is so far behind the times they can't handle electronic data, since sending them a dvd of info like photos would be so much simpler than wasting so many trees to print.

@Tahoma, I thought we front loaded quite well too, so it raises questions on if there really was some water damage at the CSC and they just do RFE's instead of admit it, or even that they maybe misplaced evidence and find it easier to send the RFE. Or it could be you got the conscientious employee that really looked at it all and we got the lazy one that thumbed through it. Oh well, at least we now know what they want and trust me, I already have it all ready to go now, just need to do alot of printing tomorrow and get it back to them.

We had the same thing (plus one more) in our RFE. Please read our post about what we did to reply. Unfortunately in your RFE instructions, it states only photos with hard coded dates on the picture count. I would try to find other ways of proving you met within the 2 year window. We organized our reply with 4 trips. Each trip, we showed the visa page with the entry stamp, airline receipts, hotel receipts and credit card statements to prove we were there. I also included the photo from each place for good measure, but it will not count as evidence since they were digital and no date stamp on the picture.

Just an update, received our NOA2 notice on June 3. They had received our RFE info on May 20. So took about two weeks to process it.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
