Hi all,

My friend went to his second Naturalization interview 2 days ago, since he did not pass the English test at the first time which was 3 months ago.

At the first interview in January, he passed the U.S Civil and History questions, English writing, but failed the Oral test and questions listed on the application.

He was scheduled for the second interview, which was 2 days ago. He got interviewed by the same officer, he was very glad that he answered all the questions listed on the application correctly this time, also answered the questions (oral) the officer asked.

When the officer was about to give him the result, he had some chitchat with my friend; my friend could not understand what he was saying. Surprisingly the officer marked "you did not pass the second and final test of your English ability"......

Any ideas what my friend could do now instead of paying the application fee and 6 months waiting again?

He thinks the officer discriminates him, can he file any compliant?

There is a requirement to speak very basic English. If he cannot speak very basic English then he is not eligible to become a citizen. It is not discrimination. He should take English lessons.

Your friend is in the US for a few years now and should be able to understand and speak English, maybe invest in some ESL courses.

Its not - at my interview there were people who also failed because they did not understand English and did not comprehend the questions they were being asked. It is part of the test to understand and speak English. They suggested to the people to take some ESL classes or spend more time reading/speaking English.

Ask your friend to invest in taking ESL classes instead of spending his money on a lawsuit.

If you can't change your mind, are you sure you still have one?

Many cities have FREE ESL classes - did you friend avail him/herself of these, prior ?

If not, why not ?

Like Darnell said... Esl classes are free at most adult night schools in many cities... Being able to hold a basic conversation in English is a requirement, not just memorizing answers on the application... Being a citizen of the USA requires conversing in English so if they do not meet that basic requirement, they need to invest the time and practice until they can... Sorry, not grounds for discrimination...
