Hello everyone!

:help: I do apologize if this has been asked recently, I could not find a similar topic in this forum... And I do realize it might be a silly question but bear with me here, please... :bonk::innocent:

I am referring to applying for citizenship after AOS for spouses of US Citizens. I am a little confused about the "permanent residency" part of the process guide, meaning: Being a permanent resident (green card holder) for at least 3 years immediately preceding the date of filing Form N-400, Application for Naturalization. (quote from USCIS website).

Does this mean 3 years after the AOS (since that is when you technically become a permanent resident) or is it from the day you are granted admission via the conditional residency?? (I did notice on my two year green card it says PERMANENT RESIDENT in the upper right corner...)

I am getting controversial statements from VJ too ( From this topic and From this topic as well ) and wanted to see if anyone had more current info on this.

Count 3 years minus 90 days from the "resident since" date on your card. A "conditional" permanent resident is still a permanent resident.

Use the permanent resident since date on your green card and add 3 years to that date. 90 days prior to the date, you can apply for naturalization. Hope that helps! :)

I think you are confused about a few things here. You did consular filing and you never did AOS. AOS = the process for people to originally get a (possibly conditional) green card while in the U.S. If you did AOS, then when the AOS is approved is when you became a permanent resident. But you did consular filing, so when you arrived in the U.S. is when you became a permanent resident. Also, conditional permanent residents are permanent residents.

From the time we received that I-751 stating that you are free to stay here during the processing time, would have been nice if we could use that date. But took another 13 months to process our AOS. Did send an extra 600 bucks least to get a couple of EAD cards so I could add my wife to my two hundred buck bank account, had the APA to deal with. And let my stepdaughter start school, even though there was a supreme court decision stating as long as she was here, she can go to school. But the DOS says, she cannot, even after that supreme court ruling.

But I could agree with the APA if my wife had 25 million bucks to deposit.

Just a coincidence this delay let my stepdaughter turn barely over 18 at the earliest date that my wife could apply for her US citizenship. Did get an extra 680 bucks extra, but wasn't as bad as having to drive an additional 1,350 miles and all that extra time off of work.

It's clearly the date you first receive that conditional green card when the clock starts ticking for applying for US citizenship. Stepdaughters conditional card due to a misplaced I-130 came in 45 days later. They sure screwed up on this, if delayed it another 45 days, could have hit us with an additional fee for an extra I-751. But did get us for an additional N-400.

That I-751 was sure a bad joke, more loopholes in that form than Carter has liver pills. Then with delays in that, another 450 mile trip to get an I-551 stamp in a foreign passport book. But they didn't charge extra for that.

I did wonder about the requirements to get that all important job of becoming the director of the newly formed USCIS. Only requirement I could find was to help the current president become elected. Did find the old INS forms, written in perfect English and fully comprehensible. Emilio sure changed that around, can only gather his efforts were to increase the income of immigration attorneys. But that didn't work out, it was their board that got him kicked out. With three some acting directors after him, still have the same messed up forms.

Is a requirement for being on the other end of that 800 number, just simply, simply know nothing. How about that legal difference between the words, AND and OR?
