My fiancee's visa petition was rejected. I dont even know the clear reason. We were both divorced, eligible to marry and provided all the evidence needed. These were chat logs, phone calls and such.

I have created a petition on the white house site. Can you guys please sign my petition?

Have you called USCIS to find out why you've been rejected? No point doing a petition online till you know the reasons why.

It's a notable effort, but trying to get 100,000 people to sign a petition when they have no idea who you are, who your fiancee is, or the circumstances of your case is far fetched. I would put my efforts into finding out exactly why the visa was rejected by calling/writing USCIS. Then perhaps trying a different route to get your fiancee here. Call your congressperson, senator etc. also.

did you visit her within the 2 years prior to filing? I agree, a petition won't get a visa for your fiance, finding the reasons why it was denied and addressing those issues will. Your petition says the CO at the consulate never looked at the evidence, how do you know this? Perhaps at the interview he didn't, but I am sure before the interview he did. Also you stated it was an immigrant visa that she applied for, a K-1 is a non-immigrant visa.

The 100,000 votes you need will only get you an official response from the WH, but will not get your fiancee here. I think you are wasting your time with the petition, rather, find out exactly why the visa was not issued. There is always a reason even though it may not be apparent to you at present. You will get her here, I am sure, it just may take a bit longer and some more work, but, again, I don't think getting 100,000 people to sign your petition would do you any good. There are much bigger problems the government needs to worry about right now, they will not do anything related to anyone's fiancee.

Sri, but the Embassy COs are highly trained and if they found reason to deny your fiance's visa, then they had good reason. Maybe go and marry her and then try for a CR-1?

Hello Friends,

Thanks for your replies. The visa was denied because of 212(a)(5)(a). Reading through the posts here and on other websites, it seems to be they were not satisfied with our proof. My fiancee carried all the packets to the consulate and handed them to the CO. I have been a member of this site since the beginning so I provided the standard proofs. Chat logs, phone logs, pictures. I am talking to lawyers, senators, congressmen. I called up NVC today but they have no information. I will call up USCIS tomorrow because they close at 5PM.

My fiancee is a small town girl and probably got overwhelmed at the interview. I know the CO's are highly trained but they are human. They were rude to my fiancee and treated her like a criminal. It was not the evidence that was a problem but how my fiancee answered the questions.

I met my fiancee twice in the past 7 months. I can understand going into AP and supplying more evidence but to send the case back is sending it to a black hole again.

The lawyer I met today said I should deal with the rejection and provide them a reason before I cancel the petition. I am ready to go to India and get married asap but the lawyer said I might have a problem with a spouse visa if I dont take care of the rejection now.

I figured it would not hurt to start a petition. If nothing, it reveals that I have nothing to hide. It will also bring some transparency to this procedure.

If you guys have any suggestions, please let me know. Right now my main concern is whether I can go and get married ASAP. I want to get married but want to follow proper protocol and not create any future problems.
