Good day VJers, i know it was asked before but here goes my predicament. Don't wanna deal with an expensive lawyer to file this..

My question is which is faster for my kids aged 7 and 3 to come in the USA ? I have them with my ex boyfriend in the PHilippines, i have petition to change their lastname to mine so i would be able to petition them myself easily since me and my ex have a bad beef with each other. Now i heard its faster for a USC than a Greencard holder to petition.

Does my husband need to adopt them? What form am i gonna fill.

Please point me in the right direction, it is very expensive process i don't want to screw this up myself.thank you

if you are a greencard holder,

then your USCitizen spouse can file an I-130 on each child, with followup NVC doc intake, then an Interview at Manila IV.

Good Luck !

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.

nope - he does not need to adopt them.

They are his step-children, so the legal basis for filing a petition exists.

Darnell is right, he does not need to adopt them but they will need DNA way down the line to prove you are their mother. Also, you marriage will be looked at very closely at the consulate level( my friend had similar situation).

Another thing, I do not think they need to change their last name to yours. Once their Original birthcertificates have you as one of the parents, you are good to go. Any doubts will be cleared by DNA much later.

Your children using their father's last name will NOT in any way cause issues.

Your USC husband can file i-130 for them as Stepchildren of a US Citizen.

You need to prepare the kids' NSO birth certificates, their Philippine passports, your marriage certificate and your husband's valid US passport.
