Just thinking of some pointers and if we need to seriously start buckling down and save like mad people while we wait for our fiance visa. So my question is, once my fiance moves here we should put in an adjustment of status right? But also he should put in a EAD( Employment Authorization Document ) as well since he wants to work while we're waiting on the AOS to come through. Is this correct or am I reading too much and letting this all go over my head? Sorry with all the daft questions but I want to plan ahead a little bit since I don't want hick ups when he comes.

EAD and AP fees are waived when the EAD and AP are filed for, concurrently with the I-485.

sorry what is AP?

Advanced Parole; so the beneficiary can leave the country while waiting for AOS. (and you're aware that AOS is applied for after you're married, right? Not as soon as he arrives).

Sorry if I mistyped that, I meant that after he comes here on his fiance visa and we get married he will apply for AOS and EAD.

I should be asking, okay square one, once we get married..whats the next step? I feel so bad for being so confused.

AFTER you get married, apply for Adjustment of Status AND EAD and AP at the same time/ USUALLY (but not always) you will receive the EAD before the green card.

You should PLAN on your fiance/spouse NOT being able to work for about 4 months after you get married and file AOS. How quickly after he arrives you get married and file for AOS is up to you. He can plan on a nice long vacation while he waits.

In our case, we received the green cards before the EAD. Go figure.

The K-1 does not authorize work until you have the EAD or Green card, as with everything else, that takes time.

ah perfect!!

does anyone know if you have to pay a filing fee for each document? I read online you don't have to pay a fee for the EAD but I'm double checking? Anywhere we can save money we're all about :P

If you file EAD and AP with AOS, you don't have to pay any additional fee for EAD and AP, as Darnell said (FYI, I-485 is what you will have to file for AOS)
