Hello everyone.I have been researching online all kinds of websites trying to find out what our best option is. Thankfully I found this one.

So, my wife and I are legally married in the USA and in Brazil. We've been married for 8 months now. We've been together for 4 years and we got married in 2012.

She was living with me and my daughter here in Brazil for the past 6 months. My wife decided she wanted to move back to the us with us.

Last week the three of us flew to Orlando, unfortunately we had a problem at the border. We thought because we are legally married we ( my daughter and I )

could enter the country under our tourist visas and start our paperwork as soon as possible. We were obviously wrong and experienced a very traumatizing

situation there. They canceled our visas and sent us back to Brazil. My wife stayed in the us. We're facing two dilemmas now, thats why Im here now and would really appreciate ur experience. We found this immigration attorney who`s suggested us to file for the K3 visa along with the immigrant visa. She said my daughter and I would be in the united states within 2-3 months. After spending the whole night awake researching about it I have noticed it is a common sense among users in different websites that the K3 visa is pretty much dead. I also got to know about the CR1 visa wich she hasnt even mentioned about it. Would you guys suggest the CR1 over the K3 visa? Another thing is, we really want to be together during the processing time. We are newly weds and extremely in love with each other. Can she move back to Brazil after filling and signing all paperwork to wait till we have our visas so we can all stay together? Her parents will sponsor us and their income together are more than enough to support all of us. Or she has to stay in the us working? Thanks for ur help.

If she files the paperwork from Brazil then there is a chance your wait will be shorter since she is living abroad. I am almost finished...about 6 weeks or so until interview and I sent in my application on Nov. 15. Make sure your wife puts your Brazilian addresses on the application not the US one.

She will have to prove that she can support you and your daughter with assets/a job in the US/joint sponser and that she plans to set up domicile on the states. Read, read, read. This forum is amazing.

The Cr-1 is the way to go. There is no way that the attorney can get you to the states in 3 months (of course miracles do happen). The K3 will likely be closed at NVC or the consulate. I have not seen any K3 visa get through. Search the boards. See what you can find.

Is the daughter a US citizen?

If not, I strongly suggest the Cr-1 with both petitions being filed together. If you go for the K3 and it is close, the daughters petition will trial behind the husbands

Timeline

Don't use that attorney. If she is not up to speed with the K3 being obsolete and usually being administratively closed at NVC stage, and does not know (or is lying to you) about processing times being close to a year now, who knows what else she does not know.

Your wife can move back and file whenever she has the time.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Sure, the US Citizen can travel as they wish as long as Brazil has no problem with it. However, if not working in the USA, you'll need a plan to deal with the affidavit of support as a financially qualified sponsor is required for immigrants,

Is your daughter a US citizen? Is it possible to do a CRBA for her? Otherwise do the CR1 for you, CR2 for your daughter and away you go. It's a good thing you did your own research. It's also good that you already have joint sponsors so get your wife to get the documents she may need to prove she is re-establishing domicile, then move back to Brazil with the two of you. :) file from a Brazil address and you probably will go faster than with an American one.

hey everyone, i'm maronn's wife and so glad we found this website. now we just need some direction on how to start everything. we aren't going back to our lawyer and i am going to move back to brazil. where do we go from there? i want to make sure everything is done here that might need done before i leave. we also want the fastest possible process and know how to pay from brazil. i really appreciate your feedback. thanks
