Hi,

I have been here in the US since July 2010 on an L1-A. I got married April last year to a U.S. citizen. I thought i will apply for my g.c. after 2 years of marriage (that wasnt my wife's opinion, she has been asking me to apply from day1!) so that we dont have to go through the conditional g.c. procedures. However given the fact that after all this time i would definitely like to improve my job prospects, and not be dependent on my only employer here, we are thinking of starting the application process. Now here is my question:

Say I get approved for a g.c. and get conditional residence - when will i have to file for removal of conditions - will it be in the 90 days prior to expiration of my g.c. (which assume will be sometime in 2015 if i get approved this year), or in my case can i do it as early as next year when we complete 2 years of marriage?

I don't see the point in waiting if you're thinking of changing jobs.

Adjustment of Status from H-1B, Family-Based
07/26/2012 - 10/18/2012: 85 Days from Application Received to GC Received.
Removal of Conditions
07/22/2014 - 11/14/2014: 116 Days from Application Received to GC Received.
Naturalization
02/03/2016 - 05/31/2016 : 119 Days from Application Received to Oath Ceremony.

No, she was just telling you when you would ROC.

Ok i guess i wasnt clear in my question. If i apply now and say get approved this year, i can apply for ROC in 2015, and not next year when we complete 2 years of marriage? However if i wait till April 2014, and then get approved, i will not have to go through ROC. So which one is better?

You were very clear in your question. None of us think you should wait. That was our answer.

If you got a GC this year, you would file for ROC in 2015, NOT at your 2 year anniversary of marriage date.

If you wait you will get a 10 year green card BUT if you wanna change your job just do it now!

Apply now, You will apply for a CR-1 but by the time your case is at the interview stage, about a year, they will automatically change it to a IR-1 for you at the interview.
