I've been doing a little research on this topic. How do you guys think it's affecting us who are trying to get the IR1/CR1 visa? Does it have an effect? Just curious to see what your opinions are on the matter or if anyone really knows what's going on.

12/30/2012 Got married!

02/01/2013 Sent I-130 via Priority Mail USPS

02/05/2013 NOA1 Priority Date

04/09/2013 Called USCIS-informed by Tier 2 officer that my case was transferred to Washington D.C. on March 13

09/05/2013 NOA2

09/27/2013 NVC received case

Submitted DS-261

Paid AOS bill

10/16/2013 Paid IV bill

10/19/2013 Submitted DS-260
10/21/2013 Mailed AOS and IV packages overnight

11/15/2013 IV package accepted/Checklist for AOS

11/26/2013 New AOS documents received at NVC

12/19/2013 Case Complete

12/27/2013-Received Interview letter

01/26/2014-Husband's Medical Exam

02/13/2014-Interview- Approved, but the consular officer did not see I-864 joint sponsor documents, and sent my husband home with the packet of all the original documents, and told him to mail it in when he gets it. My husband realized that the "missing" documents had been there all along. Husband immediately mailed it back.

02/26/2014-Consular office received "missing" documents and gave it to CO for review

03/17/2014-Visa Issued!

03/20/2014- Received Visa

03/21/2014- POE!

this same issue was already discuss when it first came up back on July 2012...It's hard to tell actually. Normally, the spouse visa, takes between 7 to 11 month, compare to the k1 visa.

But I've been watching that things are pretty slow compare to 2011 and the first 3 month of 2012. It took me 4 month to get my noa2 and 7 month since we applied until I got here to the US. Most of the people I met back then (with my same timeline) took them less than 8 month to complete the process.

But Im not sure if it has something to do with the dream act

Near as I can tell it is mostly having the worst effects on the people that have an NOA1 prior to Aug. 15th. On Aug. 15th they started routing to the local field offices and NBC to offset the incoming dream act applications. But if you filed prior to Aug 15th there are people still waiting for their NOA2's while people that are being re-routed, if you will, are getting approved in sometimes as short as 60 days or 6 months. I am sure that depends on the complexity of their cases. But, there are still a pretty good number of June, July, and early Aug filers that have been waiting almost 9 months now just to get their NOA2. So it depends on which side of Aug 15th you are standing regarding how much impact it has had.

My wife and I got very lucky.

Also, this is just my thoughts from where I am sitting. Others may perceive it differently.

Relationship and I-130 Process

Sometime in October, 2011: We met online talking about Argentina.
Later in October: Met in person in Philadelphia and became good friends.
March 4, 2012: Became girlfriend and boyfriend, officially.
March 21: Gloria leaves the US at the end of her J-1 Visa.
April 9: Got engaged!
May 12-26: Chris visits Buenos Aires.
May 18: Got married in Argentina :) Happy day!!
May 29: Sent out I-130
June 4: NOA1 received.
August 17-20: Chris visits again.
September 22-29: Chris 3rd visit, Gloria's birthday!
November 11-January 5: Chris stays in Argentina almost 2 months, Gloria is happy!
December 28: NOA2 YAY!!!
December 31: Package received at NVC.
January 18, 2013: Got case # and IIN.
February 6: Case complete!!
February 11: Interview assigned.
February 25: Package received at Embassy in Buenos Aires.
March 18: Interview Approved!!
March 28: Visa received.
March 29: Houston POE

April 11: received greencard!!!!!!!

January 9, 2015: sent out form I-751

It's important to realize that the DREAM Act is a piece of legislation that is not actually law since it hasn't been passed out of Congress yet and therefore it cannot affect petition processing at this time because it is not law.

March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Deferred action went into effect June 15, 2012. Not the dream act, as it is currently stalled, and yes I should have specified that my last post was based on this.

Yes, there is no dream act yet.

But there is DACA, which USCIS began accepting applications for on August 15. And those do appear to be impacting application processing, specifically for CSC K1s. Not sure about other types as I have only been following K1s.
