Could you please advice me?

I was caution in 2006 december in belfast to pick someone's mobile. I paid the owner the full money and I never went to court.

I have no idea if it was a caution or a warning . I was like so much frustrated that I just wanted to get the things over asap. It was in 2006 and I all I remember is that when they call me to the police station for interview, i admit it and then they took my finger print, photo, dna , interviewed on the tape and then ask me to pay the owner money and let me go in 20 minutes. i paid the owner money on the same day and later they called me back to sign a document. that's all. The police even didn't say, "You do not have to say anything. But it may harm your defense etc etc. I asked am i being arrested ot what and the police officer said no. I dont't know if he was lying to me or not.

I never went to court. i then moved from Belfast to Manchester after an year as I got a job here. They did an enhanced CRB but nothing was on it.

I am about to apply for BC in february this year. Please tell me do i need to mention about my caution there.

You're going to apply for a birth certificate? Does the application ask if you were ever detained or arrested? If it does, you were detained and you would have to mention it. But I don't know why a birth certificate application would ask for that.

I think he meant to say GC and it came out as BC.

Ok buddy, you need to talk to a REAL Immigration lawyer. While people here are very knowledgeable and know the process very well, they can't tell you if it will hurt your case or not. Mostly in USA, if you are not taken to the court or if you are not given a DAT( summons) you won't have a record, but because you were interviewed in UK, and they took fingerprints, you might be in their system and we don't know what they wrote on your file.... It is important that you talk to a criminal lawyer, or an immigration lawyer. If you can afford both, i think it will be good idea to talk to both, because you want to make sure you dont have criminal history.

Several people on here have dealt with cautions on their record successfully and without the assistance of an attorney. I suggest the OP do a search for "caution" in the UK sub-forum for more information. The only issue could be that theft is a crime of moral turpitude, though I believe there have been others who have overcome a police caution for theft in the past.

How old were you when you committed the offence?
