Twice I have sent a letter to withdraw my I-129F petition. I haven't got a response either time. The most recent two months ago. Saturday I received a letter closing the petition. They said that the "validity dates have now passed." The date passed around 18 months ago. They never investigated the denied visa request. They also say, "no further action is required."

Since the visa denial we got married. I am about to file for a CR-1 Spouse Visa. (Bringing my wife to the US. I am a natural born American.) Do I still need to push for a withdrawal of the I-129F request?

I'm going to say no. I've tried and tried to get VSC to close the I129f or revoke it. I even enlisted the help of the embassy to send it back....but they still haven't touched ours.

No they are basically telling you that your petition expired. Thats what the "validity dates have now passed." is about. So you are free to file away but just for safety sake when you send in your petition also include your withdrawal letter. Just covering your, well you know. Good luck .

No. I would have advised sending the withdrawal request WITH the I-130 petition. You COULD still do that if you want but it is not really necessary.

Facts are cheap...knowing how to use them is precious...

I would send in the old information to complete the picture with your new filing for continuity. Appears their is no since in pursing a closed file, as the saying goes: you can't fight city hall. Good Luck

I wasn't suggesting that I send the withdrawal with the I-130. My question is should I continue with the withdrawal on the I-129F. I don't know if it is important to have the withdrawal on record after the petition having been closed by USCIS.

Read my answer again. If you have a question about what I meant, please ask it. However, your I-129F is moot now, due to the USCIS action you just received notice about. I told you what I "would have" suggested.

My suggestion now is that you explain the past and include a copy of the notice with your I-130 filing. There was never any reason to delay filing your I-130 after marriage. No need to wait for acknowledgment of your I-129F withdrawal. You COULD HAVE simply sent the withdrawal with the I-130. You didn't. No worries. It's dead and gone along with the all the time from when you COULD HAVE filed the I-130 until now.
