hey everyone,

i've read most of the topics concerning re-entry permit but couldn't find a case like mine or how to solve it..i have been a permanent resident since 2006 and i've been travelling back and forth to my country egypt to complete my studies in medical school..as i am graduating in 3 months and afterwards i am required to fulfill the call for military service that i wont be able to get back to the states for 18 months..so i thought of applying for a reentry permit..i managed to reserve a ticket to leave from egypt to the states on dec 19th and come back on jan 18th and i heard that biometrics for fingerprints appointment takes 2-8 weeks..so as my relatives is there i was thinking of making them send the form by mail so that as soon as i arrive there it wud have given 2 weeks so i coud have the appointement while i am there..is it applicable to make them file the form or not till i arrive to the states in two weeks..or is there a way i cud make them make me an exceptional appointement for my finger prints before i leave after filing the form myself??

No. You cannot file a Form I-131 to obtain a reentry permit unless

you are physically present in the United States when you file the

form.

You should file your Form I-131 no fewer than 60 days before you

intend to travel abroad.

If I file Form I-131 to get a reentry permit while I am in

the United States, will USCIS deny the Form I-131 if I

leave the United States while the form is still pending?

We recommend that you file Form I-131 while you are in the United

States. However, you do not have to be in the United States for

USCIS to approve your Form I-131 and issue a reentry permit to

you if your biometrics have been obtained. You can indicate on your

Form I-131 that you want USCIS to send your reentry permit to a

U.S. Embassy, or consulate, or a DHS office overseas, so you can

pick it up from one of those facilities.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Interesting.

Serving in a foreign military should not directly be a bar.

But how you also maintain residency, well that is more of a challenge.

by applying for reentry permit u dont maintain any residency u had and u start counting all over again..i have been a medical student and i have been going back and forth the past 6 years only staying in the states for 2 weeks-1 month/year for the circumstances of my studying..i am trying to end everything in egypt so i can stay in the states and apply for citizenship...
