Dear all

My husband has applied for my visa under IR1/CR1 in mid April. It has been 7.5 months and we have not heard back. I live in Pakistan and he in NY so he applied to the Vermont Service Center. I also have a valid US visit visa. We also applied for an expedition on humanitarian grounds but it got rejected. We have also given a handsome amount to an immigration lawyer but she has not told us what we should be doing now. I even got information about the expedition etc. on this forum. Does anyone has any idea if we have any other options to get the process done quickly?

First of all, your husband did not apply for anything and he did not apply to the service center in Vermont. He filed a petition at an intake facility and that facility sent the petition to Vermont.

Since the expedite request was rejected, there is nothing much else that can be done except to make an inquiry with USCIS. Others have posted that Vermont is slow-going right now in adjudication I-130 petitions.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

December 9, 2025:  N-400 interview - approved

I dont know what others recommend but my experiance has been that lawyers will delay the process of your case so best thing to do is discontinue the use of a lawyer unless your case is complicated meaning Divorces and possible pending legal issues. The visa application system is designed so a 12th grade graduate can complete the process.

at the point you are at just wait for NOA2 and then the rest will go pretty quickly you should be hearing back very soon. Call DOS to check the status of yoru case if you have not heard anything for a while.

Why haven't you made use of your tourist visa at least to be here a few months while you wait?

I know if my wife had one we would have at least tried, even if they did turn her back at the POE.

Your hubby should be allowed to submit a service request now. He is out of current processing times, which are in May. He filed in April. Get him to call USCIS at their toll free number to submit a service request so you'll get an answer soon as to what they are waiting for or if they can just approved/deny the petition.

We just heard back. The petition for I130 has been approved. How long will it take before I will be interviewed?

Ok, the I-130 has been approved. What does this mean?

This means that the USCIS has found that a valid family relationship exists between you and your husband. you are now allowed to apply for an immigrant visa.

The case will be forwarded from Vermont to the National Visa Center in New Hampshire for visa processing. You will need a case number from the NVC before you can proceed. It takes about two weeks for the NVC to get your information into their system. Start calling them in about a week and ask for a case number and an invoice identification number (Their number is 603 334 0700). You'll need these. In the meanwhile, get a police certificate and an original birth certificate. Tell your husband to order his IRS tax return transcripts for 2011, 2010 and 2009.

When you get your case number and IIN, the NVC process could be done in as little as 2 - 3 weeks if you follow the guide I linked you to above step by step. After that, it'll take 1 - 2 months before your interview.
