Husband came over with a K1 visa. We got married a month ago, but his I94 expired on October 29, his visa will expire tomorrow November 13. Will there be any issues with immigration if we put his AOS papers on the mail one or a few days later?

You need not worry. So long as you married within 90 days after his arrival, you can file for AOS whenever you're ready, even if his I-94 is expired. However the longer you wait the longer he will not be able to work, get a DL and get going with his life.

We waited 10 months, Filed our AOS in August, and had our interview on 10/30, and received her GC on 11/7. Just make sure you do it before 1 year, otherwise you will have to take another medical with a Civil Surgeon, which costs money. Good Luck on your Journey, God Bless.

No problem if you send the AOS papers 1 or few days later! We sent my papers like 2 days after the i94 expired and not problem so far! Dont worry. Of course the sooner the better. So your husband can start receiving his EAD and AP soon.

Others have pointed out all the details exect for one. Once the I-94 exires, your husband is accruing out-of-status days, Should he reach 180 days before filing, the Advance Parole would be worthless as he will not be re-admitted to the US with the AP.

File as soon as you can.

This. Every day that passes between the expiration of the I-94 and the filing of AOS is a day that your husband is out of status. Being out of status is never a good thing.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.
