Hi everyone,

I need your help.. My ex and i, realized its not working for both of us, i met him about a year ago, he filed the visa February (2012) and he cancelled it in June. Last month, when i checked the visa status at the USCIS web, it is on DECISION phase already. I dont want to contact my ex to ask if its DENIED or APPROVED. But, considering that we did not comply to any documents needed, i assumed the visa has been DENIED. I am asking your opinion, do you think it is DENIED?? When is the most appropriate time to apply for another visa for me? I hope to hear from you, your comments would be much appreciated. THANK YOU and STAY HAPPY and BLESSED..

what kind of visa are you referring to K1, CR-1? what do you mean by you did not comply with documents submission? and what kind of visa do you now plan to apply for. Hopefully with these, you will get better answers from members.

09/15/2012: Got Married
09/26/2012: Mailed I-130 from Nigeria( delayed by customs)
USCIS stage ( 66 days)
10/12/2012: NOA 1
12/17/2012: NOA 2 (case was transferred to NYC office 11/27/12)
NVC stage ( 20 days)
01/08/2013: Case # and IIN assigned ( file arrived NVC mail room 12/20/12)
01/09/2013: AOS invoiced and paid, DS-3032 emailed and mailed.
01/16/2013: IV invoiced &paid. AOS & IV mailed in one package(arrived 01/18).

01/28/2013: Case complete!!!
04/19/2013: Interview; APPROVED!!!!!
05/13/2013: POE; JFK

If your fiance visa has, in fact, been denied then yes, you may apply for a Cr-1 visa once you are married

If you do marry your current fiance shortly after your ex canceled the petition (I assume it is 2 different men) then expect scrutiny. 2 different men in a short amount of time looks suspicious

thank you for that, i appreciate it. Yes, im readying myself for that, but i guess, all i have to do is tell the truth, that i have fall out of love from him. My current fiance is an ex boyfriend from 2006. We found our way back to each other. And also, the reason why i fall out from my fiance#1, i caught him in exchanging emails with 2 other girls, one from Dubai, and the other is a fellow filipina.

No visa has been applied for, so no visa has been denied. A petition for fiance was filed. Only if and after approved would the foreigner apply for any visa. This foreigner has not applied for a visa. If they marry a US Citizen, the Citizen is free to file a petition for the foreign relative/spouse. When THAT "petition" is approved, the foreign spouse will apply for a visa.

Please be careful not to confuse people by referring to petitions as visa applications.

Also, it would appear the petition was denied for failing to properly respond to a request for initial evidence, not "cancelled" or "withdrawn".

if you know the USCIS receipt #, hey ! Call into USCIS and ask for casefile status.

That online portal thingie isn't so accurate.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
