I am going to sponsor my sister, who is married and has two little kids.

Reading the forum for bringing family members here http://www.visajourney.com/content/ussibpet

I see that we need to have the same mother ;-), which we do ( we have the same father too ;-) ), and then I see this at the end

So, my question again is, do I have to simply sponsor HER, and not mention her husband, and kids, so that when she can come over, ( HOW LONG WILL IT TAKE ? ), than they will be allowed ( GET VISAS ), to come along with her ?

Assuming she is also from Brazil then the current wait for F4 classification (brother or sister of a US citizen) is approximately eleven years.

I believe when you filled your application they will ask you to listed beneficiary in the application. You have to list them somehow in order for them to join with your sister . In another word , they can allow to get visa with your sister as long you listed them as beneficiary but age is another issue just make sure they are not aging out when your case is current . I recommend you should seek for legal advice

no, what it means is that you do not file a i130 form for each person (the first form), you only flle one i130 for all of them, on number C17 on the form, it states to write down the spouse's and children's names of the beneficiary. that's where you will write down all of their names.

the petition takes more than 10 year, almost 12 now.

thanks guys. that is all I needed.

Their kids are 2 and 4, so, she is looking to have options for them when they are grown, since they already have an european passaport, and this would pretty much give them access to North america as well, in case they wanted to go to school here ;-)

Now, I just need to find a relative that is Chinese or Japanese, and we will be all set ;-)

I think you may be interpreting this a little loosely. They will be eligible as derivatives to apply for an immigrant visa when your sister becomes eligible to apply. However, in order for that immigrant visa to be of any use to them they must actually immigrate to the United States. After that, they must reside in the United States in order to maintain that immigrant status. They won't get a US passport unless and until they become US citizens.

What I'm saying is that this isn't simply "another option" for them. Once your sister applies for her visa then her kids can either apply for their visas at the same time, or within one year after that. Once they get their visas then they have six months to enter the US with that visa. At that point, the become US immigrants, and all of the rules that apply to maintaining their immigrant status go into effect. They could not, for example, come to the US, get their green cards, and then head off to Europe for three years.

Thanks JimVaPhoung , and I understand what you are saying, and that is exactly what I mean. We are going to do this, so that, in 10, 12 years or so, she will have the option to immigrate or not.

So, in a sense, they will have a choice then, and will be able to come here, like I did, 27 years ago, and became a US Citizen 15 years ago.
