Permanent Resident - US citizenship

Timeline

I got my green card last April 2012 through the F2A petition of my wife, she too WAS a green card then. Yesterday she became a naturalized US Citizen, am I included to the provision in which I can file for naturalization as well after 3 years,..?

* You may also apply for citizenship if

1. you have been a lawful permanent resident for 3 years if you obtained LPR status based on a marriage to a U.S. citizen, and you have been married to and living with the same citizen for the past three years (Note that the 3-year period starts with the date your green card is approved, even if it is a conditional green card);

Do I qualify for this,..?

Or I really have to wait out the full 5 years before I can file for my naturalization,...

Would love to hear your experiences,

I'll be calling USCIS in a while to inquire, will update the forum later just in case,...

I think you don't have to wait the 5 years of residency to become in a US citizen. You are now married to an US citizen and the law says clearly that an spouse of a US citizen, can get the right of naturalization after 3 years of marriage (living and married with same spouse of course)

But maybe I'm wrong...In my case I do apply for that rule cause I'm married to an US citizen, but he is a citizen since he was 11. That means he was ALREADY an USC when he made my k1 petition.

I hope that rule applies for you too, but if is not you can still be a US citizen either way. Good luck

That is a new one for me a visa being given when the petitioner is only a green card holder.

I don't know an answer for that one being you didn't marry a USC at the time.

After your wife has been a USC for 3 years you can file.

Otherwise you need to wait for 5 years.

I would think you can apply in 3 years from the date she became a USC, not 3 years of the date of your marriage since she wasn't a USC at the time.

and YES, I can actually file for naturalization after 3 years,..!

and our teens who are both under 18, will automatically become USC as well,... :thumbs:

1. Three years from the date of your marriage?

or...

2. Three years from the date of your spouse's citizenship?

Based on cardilene's post, I think it's 3yrs from the date of his wife became a USC :)

Oct2-15,2011 - first time together (Philippines)
Feb2012 - gathered K1 requirements
March23 - I-129f sent to Dallas lockbox
Mar26 - noa1 routed to VSC (email/text)
March29 - touched
Sep18 - Finally.. NOA2!!!
Oct11 & 12 - SLEC medical exam - PASSED!
Oct24 - USEM Manila interview - PASSED! Thanks God..
Nov13 - POE DFW, TX
Nov20 - Dallas,TX wedding

Feb12 - AOS sent

Mar13 - Biometrics

Apr6 - got my EAD/AP
