I have been in a relationship with my girlfriend for 3 years now.She lived in Philippines when we started the relationship.So here is the deal,we met online because we share the same religion and from there our love grew until now,we have communicated a million times with phone calls,skype,fb all that.So she holds dual citizenship and recently moved to united states to settle.In my case i traveled to united states march this year on a tourist visa to visit friends and am legal till March next year. The thing is we plan to get married here so we can start all the process soon.She lives with her aunt so i dont know if that will be an issue with the petition.And since we are all here we plan to meet soon.Is there any advice there that would help?Any tips on how to go through this process.?Thank you.

Got Engaged shortly after then Married on Dec 2012

DAY 9--Apr11 NOA Rejection incorrect fees
DAY 10-Apr12 Made fee correction and sent back the package
DAY 12-Apr14 Package received at USCIS signed by R MERCADO.
DAY 19-Apr22 Email and text notification
DAY 20-Apr23 NOA1 Hard copy through mail
DAY 23-Apr26 Biometrics letter received through mail scheduled for May 14

DAY 36-May 9 RFE in mail

DAY 42-May15 Walk in biometrics taken at San Francisco testing centre

DAY 91- July 4 RFE sent

DAY 95- July 11 Case moved to RFE reviewing

DAY 103- Infopass appointment for Advance Parole (travel document) San Francisco... Issued same day on spot.

DAY 114- July 22 case moved to Interview and testing

DAY 116- july 24 EAD card in production

DAY 121- July 29 EAD card received in mail

DAY 124 - Aug 1 Interview appointment notice received on mail for August 28

DAY 132 -Aug 28 Interview held SF Case to be reviewed decision in 30 days

DAY 136- Sep 1 Green card Approved

DAY 138- Sep 3 Green card production Ordered.

DAY 142- Sep 7 Welcome and approval letter in mail.

Need more info...:

- So you haven't met in person yet? There is nothing you can do until you meet in person.

- How come your tourist visa is valid a year? They are usually valid a max of 6 months.

- You posted in the K1 (fiance visa) forum, but talk about marriage. When do you plan to get married? If you plan to get married soon, then you go back to whatever country you are from and she petitions you, tat would be the CR-1 spousal visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yes we have not met in person but plan to do that soon. When i was coming to US i managed to convince them and they gave me a one year stay since i had good standings.As soon as we meet it wont take long till we get married.Do i really have to go back to my country?She can not petition while am here?

Sure she can, but filing a petition does not extend your stay. You have until March of next year. If you got married today and filed tomorrow your visa will not be finished by March. You will have to return to your country when your authority to stay expires and also for the visa interview

Are you sure your I-94 is valid for a year?

That's the first time I've heard about I-94 being valid for a year. Maybe you confused a visa with I-94.

Tourist visa can be valid for a year, but your I-94 (which you filled out on the flight, and its part was stamped into your passport) has an exact date to which you can stay in the US.

Please check it, and pardon me if I'm wrong.

I agree with Asia. I have never heard of the stay being 1 year to start. Under some circumstances, such as the birth of a child, you can extend the stay from 6 months to a year once in the USA, but the embassy does not decide on the stay, the officer at the border does.

I understand that most people dont get a year but i did.I am not confusing between both.Actually both are each one year.
